RES 96-37 SCHEDULING AN APPEAL HEARING FOR WILLIAM MARX AND LINDA COCHRANRESOLUTION NO. 96-37
A RESOLUTION of the City Council of the City of
Bainbridge Island, Washington, scheduling an appeal
hearing regarding the Appeal of Hearing Examiner's
Order filed July 15, 1996 by William A. Marx, Applicants
Representative and by Linda Cochran, Fort Ward Neighborhood
Association.
WHEREAS, John & Debra Marx submitted a Regulated Activities Permit on November
1, 1993 to clear and grade eleven (11) lots (6 lots have been deleted from the application) in the
Fort Ward area for construction of a single-family home on each lot;
WHEREAS, a SEPA determination was published on June' 16, 1995 and was
subsequently appealed by applicant's representative William A. Marx and by Fort Ward
Neighborhood Association representative Linda Cochran; and
WHEREAS, the Hearing Examiner conducted a public hearing on September 9, 1995 and
on October 23, 1995 for which she issued an order denying the appeals of the Applicants and
the Fort Ward Neighbhorhood Association; and
WHEREAS, an appeal to the Administrative Reasonable Economic Use Exception
Decision issued on December 21, 1995, was filed by the applicants and by the Fort Ward
Neighborhood Association and placed on hold pending the Fort Ward Neighborhood Planning
process; and
WHEREAS, the Hearing Examiner conducted a public hearing on June 13, 1996 and on
July 5, 1996 and issued an order which affirmed the Director's Administrative Reasonable
Economic Use Exception decision; and
WHEREAS, on July 15, 1996, the City Clerk received appeals from applicant's
representative William A. Marx and by Fort Ward Neighborhood Association representative
Linda Cochran to the Hearing Examiner's order; and
WHEREAS, the City is required to conduct an appeal hearing; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
RESOLVES AS FOLLOWS:
Section 1. An appeal hearing is scheduled for Thursday, November 7, 1996, in the
Bainbridge Commons multi-purpose room, 402 Bjune Drive SW, Bainbridge Island, Washington,
at 7:00 PM to consider regarding the appeal filed by William A. Marx and Linda Cochran of
the Hearing Examiner's Order affirming the Reasonable Economic Use Exception.
Section 2. The City Clerk is authorized and directed to publish notice of a scheduled
appeal hearing and to mail notice of said hearing to those who made comment at the June 13,
1996 and July 5, 1996, Public Hearing.
