RES 96-43 ADOPTION OF SSDP FOR WA STATE FERRIES EMERGENCY GENERATORRESOLUTION NO. 96-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, ADOPTING A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT FOR WASHINGTON STATE FERRIES INSTALLATION OF AN EMERGENCY GENERATOR (SSDP04-09-96-1) WHEREAS, an application has been submitted to the City of Bainbridge Island, Washington, by Washington State Ferries for a Shoreline Substantial Development permit to construct the following at the ferry terminal at 270 Olympic Drive: (1) install an 11 -foot high, 300KW diesel powered emergency generator on 900 square feet of new impervious surface on the dock, (2) upgrade power distribution for shorepower connections for Jumbo Mark II vessels, (3) replace electrical conduits on the side of the existing dock, (4) remove existing power poles and overhead lines, (5) provide new electrical and telephone service to the terminal building along with a new electrical service transformer, concrete pad, screening and meter. New utility lines will be placed in a trench 150 feet long and 4 feet wide by 2 to 3 feet deep along the staircase north of the dock, across Olympic Drive and along the edge of holding facility pavement on the south side of the dock; and WHEREAS, the City of Bainbridge Island Planning Commission found that (1) The development is consistent with the goals and policies of the applicable Shoreline Management Master Program; (2) The development is permitted by the general regulations; (3) The use is permitted in the urban shoreline designation; and (4) The development will not cause an accessory use or activity inconsistent with the goals; policies and regulations in the SMP; and WHEREAS, the City of Bainbridge Island Planning Commission determined the proposal was minor in nature, of relatively small scale and generated no significant public controversy; and WHEREAS, the City of Bainbridge Island Planning Commission modified and adopted the staff report as its findings of fact, conclusions of law and recommendation and referred this proposal to the City Council without a public hearing before the hearing examiner and that no public hearing was needed; and WHEREAS, the City Council of the City of Bainbridge Island, Washington, has determined it to be in the public interest to adopt the Findings of Fact, Conclusions of Law and Recommendation of the Bainbridge Island Planning Commission at its regular Council meeting, of December 5, 1996; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The SSDP application is approved for the Wasington' State Ferries to construct the following at the ferry terminal at 270 Olympic Drive: (1) install an 11 -foot high, prior to any work occurring in the upland area. 7. Standard details shall be provided for the temporary erosion control measures or a knowledgeable Engineer shall be on site to direct the contractors during installation. 8. A specific location shall be assigned for concrete truck wash. The concrete or wastewater from washout shall not enter the conveyance or Sound. 9. Revegetation is required in the trenched area. No new landscaping on the bank will be required. 10. Construction staging areas and concrete truck washes will be outside of the 50 -foot wetland buffers. 11. Disturbed buffer areas shall be replanted with native plantings. 12. An ornamental fence shall be installed as a screen. 13. No staging or truck wash shall be allowed within the 50 -foot wetland buffer. 14. The generator will be operated only during daylight hours and during power outages. 15. The covered area not used by the generator shall be available for bicycle staging. Options. The Council will not act on this transmittal for 30 days so that any interested party may submit a written request for a formal public hearing (BIMC16.12.880(K)). The Council may conduct a public hearing on its own initiative. After the 30 days, if no public hearing is conducted, the Council will take one of the following actions: 1. Accept the Planning Commission's Findings of Fact, Conclusions of Law and Recommendation and adopt them by reference as its order; or 2. Modify or reject the Planning Commission's Findings of Fact, Conclusions of Law and Recommendation and prepare its own to support its decision. Recommendation. Move to accept the Planning Commission's Findings of Fact, Conclusions of Law and Recommendation and adopt them by reference as its order in Resolution #96-43 . Attachments. 1.
