RES 97-02 SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT FOR THE WHARFSIDE MIXED USE PROJECTRESOLUTION NO. 97-02
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON. ADOPTING A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT
FOR THE WHARFSIDE MIXED-USE PROJECT (SSDP06-21-96-1).
WHEREAS, an application has been submitted to the City of Bainbridge Island,
Washington, by Mr. Pat Munter, Applicants Representative, for a Shoreline Substantial
Development Permit to construct the following on 1.9 acres located in SEC. 27, TWN. 25, R. 2W
at TPNs 272502-4-085, 086, 087: (1) 35,000 square foot mixed-use project with commercial,
office, marina sales and residential units; (2) an tory 'parking lot to accommodate
approximately 95 cars (3) public trail (4) public boardwalk (5) storm water outfalls; (6) extension
of accessory utility lines; and (7) change the use of an existing single-family dock to a commercial
dock.
WHEREAS, the City of Bainbridge Island Planning Commission found that (1) The
development is consistent with the goals and policies of the applicable Shoreline Management
Master Program; (2) The development is permitted by the general regulations; (3) The use is
permitted in the Rural Environment contingent on approval of a Shoreline Conditional Use Permit
by the Washington'State Department of Ecology; and (4) The development will not cause an
~ry use or activity inconsistent with the goals, policies and regulations in the SMP; and
WHEREAS, the City of Bainbridge Island Planning Commission determined no public
heating would be required because the proposal is consistent with the Shoreline Master Program
and the City's Comprehensive Plan and generated no significant public controversy; and
WHEREAS, The City of Bainbridge Island Planning Commission modified and adopted the
staff report as its findings of fact, conclusions of law and recommendation and referred this
proposal to the City Council; and
WHEREAS, a Notice of Decision and Mitigated Determination of Nonsignificance was
issued November 6, 1996; and
WIqEREAS, the City Council of the City of Bainbridge Island, Washington, received a
request for a public hearing on November 14, 1996; and
WHEREAS, the City Council of the City of Bainbridge Island held a public hearing at its
regular Council meeting on January 16, 1997; and
WlqERE~S, the City Council of the City of Bainbridge Island, Washington, amended
Condition 4 of the Findings of Fact, Conclusion of Law and Recommendation of the Bainbridge
Island Planning Commission to read, "The applicant shall grant to the City an easement for public
use of the shoreline trail, view point, and the boardwalk (as shown in the 11/11/96 site plan) and
shall construct and maintain the shoreline trail, view point and boardwalk. "; and
WHEREAS, the City Council of the City of Bainbridge Island, Washington, at its regular
Council meeting on January 16, 1997, has determined it to be in the public interest to adopt the
Findings of Fact, Conclusions of Law and Recommendation of the Bainbridge Island Planning
Commission; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DOES RESOLVE AS FOLLOWS:
Section 1. The SSDP application is approved for the construction of (1) 35,000 square foot
mixed-use project with commercial, office, marina sales and residential units; (2) an accessory
parking lot to accommc~te approximately 95 cars (3) public trail (4) public boardwalk (5) storm
water outfalls; (6) extension of accessory utility lines; and (7) change the use of an existing single-
family dock to a commercial dock.
Section 2. The Findings of Fact, Conclusions of Law and Recommendation, attached as
Exhibit A, is hereby adopted by the City Council.
