RES 98-26 PLAN REGARDING DEXTER STREET REPLACEMENT OPTIONS05/29/98 11:41 FAX 425 635 7750 INSLEE-BEST ~ CITY OF B.I. ~002/007 RESOLUTION NO. 98- 26 A RESOLUTION of the City Council of the City of Bainbridge Island, Washington, adopting the Plan Regarding Dexter Street Replacement Options. WHEREAS, on February 5, 1998, the City Council adopted Resolution No. 98-05 initiating the vacation of a portion of the fight-of-way known as Dexter Street, which abuts on a body of water; and WHEREAS, on March 19, 1998, the City Council held a public hearing on the issue of whether the City should vacate the portion of Dexter Street; and WHEREAS, under RCW 35.79.035(1)(c) and BIMC 12.34.120A.3, the City is authorized to vacate a portion of a right-of-way that abuts on a body of water to enable the City to implement a plan that provides comparable or improved public access to the same shoreline area on which the fight-of-way to be vacated abuts; and WHEREAS, the City's Road End Committee has submitted the Plan Regarding Dexter Sweet Replacement Options, attached as Exhibit A, which provides comparable or improvecl public access to the same shoreline area as Dexter Street; and WHEREAS, the City Council determined that it is in the best interests of the City to adopt the Plan; now, therefore BE IT KF~OLVED BY THE CITY COUNCIL OF THE CITY BAINBRIDGE ISLAND, WASHINGTON, that the Plan Regarding Dexter Street Replacement Options, ached as Exhibit A and incorporated by this reference, is actopted as the City's plan providing comparable or improved public access to the same shoreline area as Dexter Street. At its June 4, 1998, regular meeting the Bainbridge Island City Council approved Resolution No. 98-26, providing as exhibit "A", a plan to complete the fight-of-way vacation of property located at 15670 Euclid Avenue NE, Bainbridge Island, Washington. The vacated property will be divided and sold to the Hodges estate and to Robert and Terri Lane neighbors of the Hodges home. The property affected by the fight-of-way vacation is located on a road end abutting shoreline in the Port Madison area of Bainbridge Island. The City followed all the requirements of Bainbridge Island Municipal code section 12.34.120, Vacation of Waterfront Streets, which mandates the vacation of waterfront streets abutting a body of salt or fresh water only if the vacation is sought to enable the City to acquire property for port purposes, beach or water access purposes, boat moorage or launching sites, park, public view, recreation, or educational purposes, or other public uses; only if an inventory is compiled of all fight-of-way within the city that abut the same body of water that is abutted by the street or alley sought to be vacated, and; that moneys received from the vacation may be used by the City only for the purpose of acquiring additional beach or water access, additional public view sites to a body of water, or additional moorage or launching sites. The City had previously ordered that a review appraisal of the subject property be performed by Anthony Gibbons (Wronsky, Gibbons & Reily PLLC) of an appraisal prepared by Nora Jewett on 12/16/97. The review appraisal found the value of the subject property to be worth $35,000 more than the appraisal conducted on 12/16/97. An ad hoc committee was appointed to identify properties which would 'suitably replace the Dexter Street road end. The ad hoc committee submitted its report on May 28, 1998, and recommended five potential properties offering possible public access to the shoreline. DEXTER STREET RIGHT-OF-WAY VACATION PLAN Goal 1. Utilize the services of the Mayor or City Administrator to negotiate the purchase of one of the following properties recommended by the Ad Hoc Committee: Sparger Loop adjacent to T' chookwap Park. An 80 foot wide waterfront parcel which can be purchased as a whole or partial piece of property and can be added to the park. Lafayette Street across from Port Monroe Sand Spit. A 130 foot, low bank bulkheaded sandy waterfront complete with 2 story house. The City should attempt to obtain access to and along the beach. Sunrise Drive NE near Day Road. A 100 foot high bank parcel. Blue Heron Lane at Brigham Street Road End. A 100 foot steeply sloped parcel located on Manzanita Bay is adjacent to the Brigham Street road - end. Yeomalt Point Drive. A 60 foot wide parcel near the end of Yeomalt Point Drive includes a modest cabin and no bank waterfront, Goal 2. Complete in 1998, the purchase of one of the recommended properties to suitably replace the Dexter Street road end and provide the public with an additional access to the shoreline. Goal 3. Utilize the proceeds of $165,000.00, received from the Hodges estate and Robert & Terri Lane along with other City funds, as necessary, to complete the purchase of property recommended by the Ad Hoc Committee.
