RES 90-51 SPECIAL ELECTION~- , e'6; ' L~ 'r S•1~ nLi~ll!•t ~ RESOLUTION NO. 90-51 /_'~ ~J~~G,- I~ A RESOLUTION of the City of Winslow, Washington, calling for a special election to be held on February 5, 1991., for the purpose of placing before certain qualified voters of Bainbridge Island., Washington, an advisory ballot containing the names of persons who are candidates for appointment of two City Council positions that will be created on March 1, 1991. WHEREAS, the question of whether the unincorporated territory of Bainbridge Island should be annexed to the City of Winslow was submitted to the voters of that unincorporated territory at a special election held on November 6, 1990; and WHEREAS, according to the unofficial results of the special election, the annexation of the unincorporated territory of Bainbridge Island to the City of Winslow was approved by a majority of the votes cast on the proposition at the special election; and WHEREAS, the City Council has determined that the effective date of the annexation shall be 12:01 a.m. on February 28, 1991; and WHEREAS, upon annexation, the number of City Council positions will increase from five to seven, and the City Council will by majority vote appoint two persons to serve in those two new positions until the general municipal election in November, 1991; and WHEREAS, by Resolution No. 90-35, adopted on September 6, 1990, the City Council declared its intent upon annexation to divide the City of Winslow into a north ward, a central ward, and a south ward; and WHEREAS, the City Council further intends to fill one new City Council position with a resident of the north ward and the other new City Council position with a resident of the south ward; and WHEREAS, in view of the apparent approval of the annexation, the City Council desires to hold special elections in the north ward and the south ward, respectively, on February 5, 1991, to place before the qualified voters of the wards, the names of persons who have filed declarations of candidacy for appointment to the two new City Council positions; and WHEREAS, the City Council intends to appoint to each new City Council position the person who receives the highest number of votes cast at each respective special election; now, therefore, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The City Council finds that an emergency exists which requires the holding of 1. a special election in the north area as described in Exhibits A and B attached hereto and made a part hereof, for the purpose of placing before the voters thereof an advisory ballot containing the names of persons residing the north ward as described in Exhibits C and D attached hereto and made a part hereof, who have declared their candidacy for appointment to one new City Council position that will be created upon the annexation of the unincorporated territory of Bainbridge Island to the City of Winslow and 2. a special election in the south .area as described and depicted in Exhibits A and B attached hereto and made a part hereof, for the purpose of placing before the voters thereof an advisory ballot containing the names of persons residing in the south ward, as described in Exhibits C and D attached hereto and made a part hereof, who have declared their candidacy for appointment to one new City Council position that will be created upon the annexation of the unincorporated territory of Bainbridge .Island to the City of Winslow. The Kitsap County Auditor is requested to concur in that finding of an emergency, and to call and conduct the special elections on February 5, 1991. Section 2. The City Clerk is authorized and directed to accept declarations of candidacy for the new City Council positions referenced in Section 1, from November 19, 1990, at 9:00 a.m., to December 5, 1990, at 5:00 p.m., and to publish notice of the filing period for declarations of candidacy in the November 21 and 28, 1990, issues of the Bainbridge Review. Such notice also shall be .posted in the offical posting places of the City of Winslow. Section 3. The City Clerk is authorized and directed to file a certified copy of this resolution immediately with the Kitsap County Board of Commissioners and the Kitsap County Auditor. The City Clerk further is authorized and directed to file with the Kitsap County Auditor on or before December 6, 1990, the names of the persons who have filed declarations of candidacy meeting the requirements of this resolution. -2- Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval, publication and posting as required by law.
