RES 90-55 WHITED'S THIRD ADDITION PRELIMINARY PLATRESOLUTION N0. 90- 55
A RESOLUTION of the City of Winslow, Washington,
approving the preliminary plat of Whited's Third
Addition to Commodore Lane on approximately
30 acres of real property located north of High
School Road, west of the existing Commodore Lane
Subdivision, and east of the Sportsman's Club
Pond and Sportsman's Club Road, upon the
application of Ronald and Bonnie Whited (file
No. 09-23-88-1).
WHEREAS, Ronald and Bonnie Whited have submitted an
application for approval of a preliminary plat; and
WHEREAS, the preliminary plat application is submitted to
develop a plat of 69 single-family lots on 29.61 acres of real
property located north of High School Road, west of the first
and second additions of Commodore Lane, and east of the
Sportsman's Club Pond and the Sportsman's Club Road; and
WHEREAS, the Planning Agency reviewed the preliminary plat
application and recommended approval thereof to the Hearing
Examiner; and
WHEREAS, on July 17, August 21 and September 12, 1989, the
Hearing Examiner held public hearings on the preliminary plat
application upon proper notice; and
WHEREAS, following the second public. hearing, the Hearing
Examiner remanded the preliminary plat application to the
Planning Agency for recommendations on certain matters; and
WHEREAS, on August 31, 1989,
special meeting to consider
September 5, 1989, made its
Hearing .Examiner; and
the Planning Agency held a
the additional matters and on
further recommendation to the
WHEREAS, on September 20, 1989, the Hearing Examiner
recommended conditional approval of the preliminary plat
application, and entered a report, findings of fact,
conclusions of law and recommendations; and
WHEREAS, on September 21, 1989, the City Council considered
the recommendation of the Hearing Examiner and decided to

change some of the conditions of approval recommended by the
Hearing Examiner; and
WHEREAS, on November 15, 1990, the City Council held a
public hearing on the preliminary plat application upon proper
notice; and
WHEREAS, the City Council has determined that approval of
the preliminary plat is in the public interest; and
WHEREAS, the City of Winslow has complied with the State
Environmental Policy Act and the SEPA Chapter of the Winslow
Municipal Code; now, therefore,
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, DOES
RESOLVE AS FOLLOWS:
Section 1. The City Council amends the recommendations
entered by the Hearing Examiner in the matter of the
application of Ronald and Bonnie Whited, file No. 09-23-88-1,
to subdivide Whited's Third Addition to Commodore Lane, as
follows:
1. Recommendation No. 1 is amended to read as follows:
The City should accept Applicants' offer to pay a fee
of $35,000.00 in lieu of a park on Lot No. 24.
2. Recommendation No. 4 is amended to read as follows:
The City should accept Applicants' offer to install a
sidewalk along the north side of High School Road abutting
360 feet of the older Commodore Lane development.
3. Recommendation No. 7 is amended to read as follows:
Interior .sidewalks five-feet i.n width shall be
installed at the outer edge of each side of the
right-of-way, and there shall be a bare planting strip
between the paving edge and the edge of the sidewalks.
Applicants shall provide a bond to secure completion of the
sidewalks in each phase of the development. As lots are
sold or transferred, the sidewalks shall be completed on a
lot-by-lot basis. The sidewalks shall be completed within
one year of the date of final plat approval for each phase
of the development. Interior streets, sidewalks and
cul-de-sac radii should meet City standards. Street lights
should minimize glare into adjacent areas.

4. The first sentence of Recommendation No. 15 is amended
to read as follows:
Applicants recognize that developers should mitigate
the negative impact on the Bainbridge Island elementary
school system to be created by the addition of so many
young school children. Applicants should mitigate such
impact by making a contribution according to a formula to
be developed by the City within five years; provided, that
Applicants contribution per lot shall not exceed $1,222 and
shall be paid on a lot-by-lot basis at the issuance of
building permits.
Section 2. The City Council adopts the report, findings of
fact, conclusions of law and recommendations of the Hearing
Examiner referred to in Section 1 above, attached hereto and by
this reference incorporated herein as Exhibit A, as amended by
Section 1 above, for the preliminary :plat of Whited's Third
Addition to Commodore Lane. The preliminary plat contains
29.61 acres of real property located north of High School Road,
east of the Sportsman's Club Pond and Sportsman's Club Road,
and west of the first and second additions of Commodore Lane,
and is more particularly described on Exhibit B attached hereto
and by this reference incorporated herein. The City Council's
approval is conditioned on full compliance by the applicant,
the developer andfor the owner, their heirs, assigns, grantees
and successors in interest, with the terms and conditions of
this resolution..
Section 3. The City Clerk-Treasurer is authorized and
directed to record a certified copy of this resolution with the
Kitsap County Auditor.
Section 4. It shall be noted on the face of the final plat
of Whited's Third Addition to Commodore Lane that such final
plat is subject to the conditions contained in this
resolution.
