Ordinance No. 2005-16 for the purpose of improving the Horizon Vier neighborhood by
the construction and connection of sanitary sever facilities, all in accordance with
Ordinance No. 2005-16, has been prepared as provided by lav and is on file with the City
Clerk at City Hall, 280 Madison Avenue North, Bainbridge Island, Washington, and it is
necessary to set the time and place- for a hearing thereon- an
WHEREAS, the City Council is of the opinion that the :hearing on,such assessment,
roll should be field and conducted before a Hearing Officer and that such officer should be
designated and appointed for that purpose to act in accordance with Ordinance No. 2006-
14 (codified as Chapter 3.50 IM.C;- and
WHEREAS, Rodney Kerslake is a. Hearing officer for the Citi, of Bainbridge
Island and has conducted many public hearings for local improvement districts over the
years for City of Tacoma and other Washington municipalities; and
WHEREAS, Mr. Kerslake is willing to serve and perforin the duties of the Hearing
Officer for the public hearing on the final assessment roll for Local Improvement District
No. 21 in accordance with the attached `Hearing Officer Agreement for Local
Improvement District leo. 21 "; now, therefore
E IT RESOLVED BY THE CITY COUNCIL OF THE CITY of
BAINBRIDGE ISLAND, WASHINGTON S EOLLOWSO
Section 1. The public hearing on the final assessment roll for Local
Improvement District No. 21 will be held and conducted before the Hearing Officer
hereinafter designated and appointed, commencing at TOO p.m. on May , 2009, in the
Council Chambers at City Hall. The City Clerk is authorized and directed' to cause notice
to be given both by mailing and publication as required by law.
Section 2. The City Council finds that Rodney Kerslake is a person qualified to
conduct final assessment roll hearings, and he is designated and appointed to perform the
duties of Hearing Officer with respect to the final assessment roll hearing in Local
Improvement District No. 21, all as provided in Ordinance No, 2006-1 {codified as
Chapter 3.50 BIMC), and iti accordaftce'with the proposed "Hearing Officer ,Ag reeihent for
Local Improvement District No. 21," on file with the City Clerk. Proper City officials- are
authorized and directed'to do all things n&-essary t6 effectuate this 'appointment (induding
execution of the Hearing Officer -Agrieement)'and -facilitate arrangements for the Hedring.
