ORD 47-03 LICENSING/REGULATIONS GAMES OF SKILL. Town of Wi slow ~
an 0rdinanoe providing for the licensing ann regulation w, for revenue
of machines used for playing g_~mes of skill for commercial purposes;
l~ohibiting minors under 18 years of age from pla~ing thereon;
providing penalities for the violation thereof, repealing all ordin-
ances and parts of ordinances in conflict herewith and declaring am
emergency.
Be it ordained by the Town of Winslow,
SeCtion 1, It s~all be unlawful for any person, firm or corporation
to maintain keep or operate at any lace or places within the Tows
of Winslow any game of skill wlthou~ first obtaining a license there-
fore in accordance with~he provisions of this 0rdinanoe.
SeCtion 2. A game of skill as uses in this 0rainsnee shall mesa ann
include any devise, devices, mashins or machines for pla~ing games of
skill, commonly known as pin ball machines or devices in which coins
may be dropped for the purpose of operating said machine, and w~xioh ma~
be legally operated within the 8~ate of Washington, provided however,
--~..that the followin devices are prohibited, except for non-profit
· private clubs: [a~ any devise for pla ing a game in which the element
of chance predominates ever skill; (bTaay devise intended for gam-
bling, or reasonable intended to be used for gambling,
Section ~; A~ person firm or corporation desiring to maintain,
operate any such game of skill as heroin defineS, shall make
t for license so to &e and file the same with the
applies ion
Town Clerk of Winslow, such applioatib- shall state the name of the
applicant, place or places of business at which any of the said machines
shall be maintained and operateS. and the total number of such games
desired to be oouvered by license. Upon the approval of such license
application and the payment of the fee therefor ae herein provided
toe Town Clerk shall issue to &aid applicant a license to operate said
machine or machines, devise or devises for which license has been app-
lied.
SeCtion 4' Each license shall be issued for a period of one month,
~'n~ monthiy license fee for each mawhiss o~ devise shall be the smn
of ten dollars ($10.00~ except music rending machines which shall be
five dollars [$~.00~ per month payable in advance.
Se0tion ~; It sixall be --lawful for ax4V person, firm or corporation
to permit or allow any such game or devise, as heroin defineS, then in
its peaslesion or undervits control to be played or operated by any
minor, under the age of 18 years,
Section 6~ No license shall be issued for the operation or mainta-
nanoe of any such mawhines or devises in any place within three hun-
drea (300) feet of ~.y private or lmblio grade or high school.
8e0tionV| After An &pplioation has been grabtea, the Town Clerk
shall have the right to renew said license for any machine or devise
from month to month, without a new application, upon pa~ent of the ~
license fee heroin provided for.
Seerion 8; The Town Clerk shall at the time of iseuin~ said licenses
'is~xe to said applioan% a tag for each machine of device so liceneeds
and the same shall be at all times displayed upon and machine or
device that is being maintained or operated in the Town of Winslow.
It shall be unlawful to operate, keep or diepk~V any such machine or
device unless one of said tags is conspicuously displayed thereon.
Section 9: The 0o~noil of the Town of Winslow shall have the right
to revoke any and all such licenses issued hereunder, either with or
without notice to t he lioenseo, and in the event of such revocation
no part of the unearned portion of such license fee shall be refunded.
Section lOl All licenses lssNea hereinu~der shall expire the last
~ay of each month; provided, that any licenses issued to any applioan%
after the fifteenth day of the Month shall pay anly S~o00 for the rema-
