ORD 80-25 AMEND ORDINANCE 77-7 SUBDIVISION PLATSAN ORDINANCE AMENDING ORDINANCE 77-7, RELATING TO
SUBDIVISIONS OF PLATS, TO PROVIDE FOR THE GRANTING
BY THE CITY COUNCIL OF ADDITIONAL EXTENSIONS OF
TIME FOR EXPIRATION OF PRELIMINARY PLAT APPROVALS.
THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON
DO ORDAIN AS FOLLOWS:
Section 1. Section 18. Preliminary Plat Approval -
Expiratio_n, of Ordinance 77-7 is hereby deemed amended to
provide as follows:
1. The approval given to a preliminary plat shall e~xpire
unless within two years following approval, a proposed
final plat in proper form is submitted to the City Engineer;
PROVIDED however, that an extension of time, not to exceed
(1) one year, may be granted by the City Council, upon the
recommendation of the Planning Agency.
2. Upon written application filed by the applicant prior
to the expiration of the extension granted in paragraph (a)
above, the City Council may grant additional extensions to
expiration of a preliminary plat approval after the following
procedures and upon the consideration set forth herein.
(a) No additional extensions shall be granted until after
the City Council has held a Public Hearing pursuant to
advertisement procedures provided in Section 8 of
Ordinance 77- 7.
(b) The time period for the additional extension shall
be determined by the City Council.
(c) In determining whether or not to grant an additional
extension, the City Council shall consider the following
factors:
(i) City ordinances in effect at the time of the
request for extension.
Kii)The present or future availability of utilities
and other public services at the time of consider-
ing the granting of an additional extension.
(iii) Changes in land use in the vicinity of the
plat which have occured between the granting
of the preliminary plat and the request for an
additional extension.
(iv) In additionl to the factors set forth above, the
City Council may consider any other relevant
factors or conditions applicable to the preliminary
plat.
(d) The City Council may, as a condition to granting any
additional extensions, impose any new or additional conditions
upon the original preliminary plat approval that the City
Council, in its descretion, deems necessary to protect the
public health and welfare.
Section 2. All other provisions of Ordinance 77-7 shall remain
in full force and effect.
Section 3. This Ordinance shall become effective five days
after posting or publication in the manner provided by law.
