ORD 53-26 ACQUISITION OF CERTAIN LANDS WITHIN WINSLOWORDINANCE NO. f
AN ORDINANCE relating to the acquisition of certain lands
within the TOWN OF WINSLOW required for the installation ~d
maintenance of a system of sewers provided for in Ordinances
23 and 24 of the Town of Winslow.
WHEREAS the Town Council of the Town of Winslow has deter-
mined that additional property is necessary for the purpose of
installing and maintaining a system of sewers and drains within
the Town of Winslow, and
WEEAS, the sites selected lie east of South Madison Street,
near its south terminus, and
WEREAS, the owners of certain properties lying within this
proposed site have refused to sell to the TOWN OF WINSLOW at a
fair and reasonable price as determined bysan impartial appraisal
and offered by the TOWN OF WINSLOW,
BE IT ORDAINED BY THE TOWN OF WINSLOW:
That the Town Attorney be and hereby is authorized to insti-
tute condemnation petition in the name of the TOWN OF WINSLOW to
secure title to the above certain properties which are described
as follows:
That portion of Government Lot 4, Section 26, Township
25 North, R~ge 2 East, W.M., Kitsap County, Washington,
described as follows:
Being the South 50 feet of the following described tract:
Beginning at a point on the center line of the established
county road, from which point the northwest corner of said
Government Lot 4 bears north 0° 4' 55" east along section
line between sections B6 and 27, said township and range,
a distance of 603.37 feet,said point being mar~ed by a hub;
^r~nning thence along the center of said county road south
0 04' 55" west, a distance of lO0 feet; thence south
89° 55' 05" west a distance of BO feet to an iron pipe on
the east margin of the said county road; thence continuing
south 89° 55' 05" east 124.12 feet to a point north
89 55' 05" west 15.88 feet from an iron pipe on the
westerly side of a ravine, said point being the true point
of beginning; thence north 89° 55' 05" west 124.12 feet
to said iron p~pe on the east margin of the county road;
thence sSuth 0 04' 58 west a distance of lO0 feet;thence
south 89 55' 05" east"to a point south 19° 15' 40" west of
the true point of beginning; thence north 19° 15' 40" east
to the true point of beginning

and , further, to secure a perpetual easement with the right,
privilege and authority to construct, re-construct, operate,
inspect and maintain a system of sewer pipe lines, together
with the appurtenances thereto, upon, across end under the
lands described as follows:
(1) A strip of land ZO feet wide lying lO feet on each side
of the following described center line.
Beginning at a point on the center line of the established
County Road from which point the Northwest corner of
Government Lot 4, Section Z6, Township Z5 north, Range 2
East, Kitsap County, Washington, bears North 0 04' 55"
east along the section line between sections Z6 and Z?,
said township and range, a distance of 603.3? feet, said
point being marked by a hub; thence ~ ong the center line

of 200 feet; thence south 89° 55' 05" east a distance of

AN AME~T TO ORDINANCE 0F COlqDY~LNATION NO. 26 re$ieing
the limits of property required.
W~REAS, by reason of revision of the engineerIs plane relative
to installation of a sewage treatment plant, the amount of property required
has eliminated the necessity of easements upon, across and under lands des-
cribed under parcels 1 and 2 in Ordinance No. 26, and
WtFAREAS, it is necessary to amend the 0curt action in the same
manner;
NOW, T~n~.w~ORE, BE IT ORDAIi~ED by the Council of the Town of
Winslow, Washington:
That the condemnm,tion action be confined to the following described
land which was included in the land to be condemned as stated in Ordinance
No. 26:
The South 40 feet of the following described property:
Parcel One (1): The North 100 feet of that portion of Government
Lot 4, Section 26, Township 25 North, Range 2 ~ast, W.M., des-
cribed as follows:
Beginning at a point on the center line of the established county
road from which point the northwest corner of Government Lot 4
bears north 0° 04t 55N east along the section line between Sec-
tions 26 and 27, said Township and Range, a distance of 603.37
feet, said point being m~rked by a hub; thence along the center
of said county road north 0o 04s 551 west a distance of 1GO feet
to the true point of beginning; thence south 89° 551 05" east a
distance of 20 feet to an iron pipe on the east margin of said
county road; thence continuing south 89° 55s 05N east 124.12
feet to a point north 89° 55~ 05" west 15.88 feet from an iron
pipe on the westerly side of said ravine; thence parallel with
the westerly side of said ravine south 19° 15t 40" west 119.8
feet; thence south 0° 041 55m west 109.90 feet to Government
meander line; thence southwesterly along said meander line to
the center of the county road and the line between Sections 26
and 27; thence north 0° 04~ 55" east along said line to the
point of true beginning, situate in Kit sap County, Washington.
Together with an easement for right of way across the north 10
feet of the south 50 feet of the said Parcel One (1).
That the Town Attorney is hereby authorized to maintain the con-
demmation to obtain only the land described above.
