ORD 56-46 CIVIL DEFENSE 0RDINANC~ NO. ~6 AI~ 0tLDINANCI relating to Civil Def~xse. l~l IT Ol~I]~e~ by the Town Council of the Town of Winslow, Wash- ingten, as follows: Section lo FUSSES. ~he declared purposes of this 0rdi~ce are to provide for the preparation and carrying out of plans, includin~ mock or practice drills, for the civil defense of persons and property within this Town in the event of a disaster, and to provide for the coordination of the civil defense and disaster functions of this Town with all other public agencies ~d affected private persons, corporations and or_-~nisations. expenditures made in connection with such civil defense and disaster act- ivities, including mutual aid activities, ~-~ mock cr practice drills, akall be deemed conclusively to be for the direct protection s~_~ benefit of the inhabitants and property of the Town of Winslow. Section 2. I~FINITIONS. A. Civil Defense. As used in this 0rd- inance, the term scivil ~sfensem shall mean the preparation for and the carrying out of all emergency functions, other than functions for which ~litary forces are primarily responsible, to prevent, minimize, and repair injury and damage resulting from disasters. It shall not include, nor does an,v provision of this ordinance apply to any condition relating to a Xh~or controversy. · . Disasters. As used in this ordinance, the term :disaster mean actual or thrcataned enemy attack, sabotage, extraordinary fire, flood, storm, epidemic, riot, earthquate or other similar public calamity. ~ection 3, CIVIL I~FENS~ COUNCIv.. Membership, The Town of Winslow Civil Defense Council is hereby created and shall consist of the followin~: The Ma~or, who shall be chairman. The director of civil defense, who shall be vice chairman. Such city officials and other citizens of this city as my be appointed by the Mayor with the advice and consent of the Town Council. section ~. CIVI~ I~FENSE CO~NCIt. Powers and D~ties. It shall be the duty of the Town of Winslow civil defense council, and it is hereby empowered, to review and recommend for adoption, civil defense _n~ mutual aid plans _=~ agreements ~-~ s,,ch resolutions, rules and regulations as are necessary to implement such plans =~d agreements. The civil defense council shall meet upon call of the ~hairsan or in his absence from the city or inability to call such meeting, upon the call of the vice chairman. Section 5. DIJ~OTOR 0F CIVIL ~F~SI. Powers and D~ties. fhere is hereby crsate~ the office of director of citil defense. Such officer shall be appointed by the Mayor with the advise and consent of the Civil Defense Council. The director is hereby empowered and directerie a. To prepare a civil defense operating plan for the ~own conform- ing to the county and state civil defense plan and program. b. To control and direct the effort of the civil defense organiza- tion of this Town for the accompli_-~--ut of the purposes of this ordinance. c. To direct coordination and cooperation between divisions, services and staff of the civil defense organisation of this Town, and te resolve questions of authority and responsibility that my arise between them. d. To represent the civil defense organization of this Town in all dealings with public or private agencies pertaining to civil defense and disaster. Section 6. In the event of disaster as heroin provided, the dir- ector is hereby empowerotis a. It mhnll be a misdemeanor, punishable by a fine of not to exceed $100o00, or by imprisonment for not to exceed one month, or both, for ax~ person during a disaster: a. To wilfully obstruct, hinder or delay an~ member of the civil defense organization in the enforcement of ~ny lawful rule or regulation issued pursuant to this ordi~nce, or in the performance of any duty imposed upon him by virtue ef this ordinance. b. To do ax4v act forbidden by any lawful rules er regulations issued pursnn-t to this ordinance, if such act is of such a nature as to give, or be likely to give assistance to the enem~, or to imperil the lives or property of inhabitants of this town, or to prevent, hinder or delay the defense or protection thereefS c. To wear, carry or display, without authority, any means of identification specified by the State Department of Civil Defense. Section 10. ~FI~CTIVX DAT~. This ordinance is hereby declared to be an emor~enc7 measure necessary for the iasaediate preservation of the p~tblic peace, health and safety, and shall take effect iWdiately. Section 11. S~V~A~ILITY. If any provision of this ordi~ce or the application thereof to an~ person or circumst_n~ces is held invalid, such invalidity shall not affect other provisions or applications of the ordin- ance which can be given effect without the invalid provision or application, ~ to this end the provisions of this ordinance are declared to be severable.
