ORD 57-56 IMPROVEMENT OF WINSLOW WAYTO~'VN OF WINSLOW, WASHINGTON AN ORDINANCE ordering the improvement of Winslow Way by blacktop paving, installing storm sewers, re- setting water mains, installing sidewalks and moving and reinstailing power poles and telephone poles; establishing Local Improvement District No. 1 ; providin9 the method of assessment in said District; and providing that payment ~ r said improvement be made by special assessments upon property in said District payable by the mode of "payment by bonds." WHEREAS, pursuant to a resolution adopted June 18, 1957, the Town Council of the Town of Winslow declared its intention to improve Winslow Way by blacktop paving, installing storm sewers, resetting water mains, install- inC sidewalks and moving and reinstailing power poles and telephone poles and fixed the 16th day of july, 1957, at 8:00 o'clock p.mo in the Town Hall in the Town of .'4inslow as the time and place for hearing objections thereto and for determining the method of payment for said improvement; and ~8{2REAS, George Roars, consulting engineer of Poulsbo~ Washington~ the Townfs engineer, has caused an estimate to be made of the cost and expense of the proposed improvement and has certified said estimate to the Tc~n Council, together with all papers and information in his possession touching the proposed improvement, a description of the boundaries of the District, a statement of what portion of the cost and expense of the improvement should be borne by the property within-the proposed District, a statement in detail of the local improvement assessments outstanding or unpaid against the pro- perty in the proposed District, and a statementof the aggregate actual valua- tion of the real estate, including 25% of the actual valuation of the improve- ments in the proposed District, according to the valuation last placed upon it for the purpose of general taxation; and WHSREAS, said estimate is accompanied by a diagram of the proposed improvement showing thereon the lots, tracts~ parcels of land or other pro- perty which will be specially benefited by the proposed improvement, and the estimated amount of the cost and expense thereof to be borne by each lot, tract, parcel of land or other property; and '/~'HEREAS, due notice of the hearing upon said Resolution was given in the manner provided by law and said hearing was held by the Town Council on July 16, 1957, and all written protests filed with the Town Council on or before said date were duly considered and all persons appear- ing at said hearing were heard; and ~HEREAS, the Town Council has determined it to be in the best interests of the Town that said improvement be carried out and that a local improvement district be created in connection therewith~ NOW, THEREFORE, BE IT ORDAINED BY THE YO~ COUNCIL OF THE IO~ OF WINSLOW, WASH- INGTCN, as follows: Section 1o It is hereby ordered that the following improvement be made on Winslow Way, to-wit: (1) The existing blacktop will be scarified and re- moved. There will be minor regrading to attain a more uniform grade and cross section area. Ballast will be hauled in as needed to provide a sound and adequately drained foundation for the 2-inch blacktop surface. (2) Existing storm sewers will be utilized where practicable with catch basins and cross drains installed to service the south side of the street. The existing and undersized 6-inch drain will be abandoned and the main line extended to run south on Madison Street to dis- charge into the gulch. (3) All water meters will be reset to sidewalk location and provision made for future water connections without undue damage to paving and sidewalks° (4) Six-foot width sidewalks will b~ built on the north side of the public right-of-way from Madison Street east to State Highway 21A, except existing sidewalk across the ravine will remain. Sidewalks on the south side of Winslow Way will be built only between ~adison and Stickson Streets. (5) Power poles will be moved to sidewalk near street ed9e and respaced for lights which will consist of 16 mercury vapor lights installed on power poles with 16-foot brackets° (6) Ielephone poles will be moved to the south alley with service on the north side provided by joint occ~apancy on power poles. all of the said improvement to be constructed in accordance with the plans and specifications prepared by the Town's engineer and filed with the Town Clcrko -2- The Town Council may modify the details of the foregoing improve- ment~ provided, such modifications do not substantially alter the purposes hereinbefore set forth. Section 2o The estimated cost and expense of said improvement is hereby declared to be $37,588°00, and the entire cost and expense of said improvement, including the cost and expense of all engineering~ legal, in- spection, advertising, publication of notices~ and other expenses incidental' thereto, shall be levied and assessed against all the property legally and properly assessable therefor as provided by the laws of the State of Washington an~ the ordinances of the Town of Winslow, and the Town shall not be liable in any manner for any portion of the cost and expense of said improvement° Section 3. There is hereby created and established a local improve- ment district to be called "Local Improvement District No. 1 ," which !~istrict is described as follows: $tarting at a point S89° 29' 30" E 20 feet from the northwest corner of Government Lot 4~ Section 26~ Town- ship 25 North, Range 2 East, W.~.; thence N 0° 32' 40" E 170 feet; thence S 89~ 29' 30" E 1585.21 feet~ thence S 0° 35' E 170 feet; thence ~ 89~ 29' 30" W 1.40 feet; thence $ 0° 30~ 30" W 30 feet~ thence $ 45° E 72.50 feet; thence 149.47 feet along a curve to the left, having a radius of 209.04 feet, and a central angle of 41° 00' 10"~ ~hence N 89~ 29~ 30" W 653.04 feet~ thence~ N 0° 32' 40" E 20 feet; thence N ~9° 29' 30" W 1054o92 feet; thence ~ 0~ 32' 40" ~ 190 feet to the point of beginning, Kitsap County~ Washington~ being in general the area from Madison Street to State Highway 21A and extending 170 feet North and approximately 200 feet South of the government lot line along ~inslow Way. Section 4. It is hereby ordered that the assessments shall be made agains~ the property in the District in accordance with the zone and term%n% metho~ provided by statute. Section 5. Local Improvement District ~arrants shall be issued in pay!~ent of the co~t and expense of the improvement herein ordered~ such war- rant~ te be payable out of the "Local Improvement Fund~ District No. 1"~ hereinafter create~, to bear interest from date hereof at a rate of not to exceed 6~ per annum and to redeemed in cash and/or by Local Improvement District -3- Bonds herein authorized to be issued. Dor~ds bearing interest at the same rate as the warrants, payable on or before twelve years from the date of issuance, shall be issued in exchange for and in redemption of any and all warrants issued hereunder nct redeemed in cash within a period of not to exceed sixty days after the first publication by the TOwn Treasurer of notice thai the assessmenl roll for Local Improvement District No. I is in his hands for collection. Said bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten equal annual installments, with interest st a rate not to exceed 6% per ann~n, to be hereafter fixed by ordinance, under the pode of "Payment by Eonds" as defined by law and the ordinances of the Town of 7~ins!ow. The exact aniount, form, date, and denominations of the warrants and bonds shall he hereafter fixed by action of the Town Council. Section 6. All cf the work necessary to be done in connection with the making of said improvement shall be done by and made by contract uFon competitive bi~s and the iOwn of Winslow shall have and reserves the right to reject any an~ all bids. Ihe call for bids for work authorized pursuanl to this Ordinance shall include a statement that pa~nent for said woi'k will be made in cash warrants drawn upon the "Construction Fund" of Local Improvement ~istrict No. I of the Town. of Winslow. Section 7. There are hereby created in the office of the Town Treasurer of the Town of ~inslow, for Local Improvement District No. 1, the following funds, to-wit: (a) "Local Improvement Fund, District No. 1," into which fund shall be deposited all payments made upon assessments in s~id District for the redemption of the warrants and bonds herein authorized; and (b) "Construction Fund," into which fund shall be deposited the principal amount plus accrued interest received from the sale of Local Improvement District ~arrants of said District herein authorized, and against which fund warrants shall be issued to the contractor or contractors in payment of the work to be done by them in connection with said improvement and against which fund warrants shall be issued in payment of all other items of expense in connection with said improvement.
