ORD 99-12 AMENDING OFFICIAL COMPREHENSIVE PLAN LAND USE MAPORDINANCE NO. 99-12
AN ORDINANCE of the City of Bainbridge Island,
Washington, mending the Official Comprehensive Plan
Land Use Map and the Official Zoning Map to correct
mapping errors on the Official Comprehensive Plan Land
Use Map and the Official Zoning Map.
WHEREAS, on February 20, 1992, by official action of the city council
through adoption of Ordinance 92-08, the official zoning map of the City of Bainbridge
Island was adopted along with Ti~e 18 of the Bainbridge Island Municipal Code, and
WHEREAS, in preparing the official zoning map for adoption, the
cartographer relied upon the Kitsap County official zoning map of December 18, 1989, as
the only record available documenting the correct zoning at the time; and
WHEREAS, on September 1, 1994, by official action of the city council
through adoption of Ordinance 94-21, the official City of Bainbridge Island comprehensive
plan land use map was adopted along with the City of Bainbridge comprehensive plan, and
which has been further airtended by ordinances 96-04 and 98-11, and
WHEREAS, The official City of Bainbridge Island comprehensive plan
land use map was created using the official zoning map of Febnm_ry 20, 1992, as a basis,
and
WHEREAS, there is evidence that the December 18 1989, Kitsap County
zoning map which was the basis of the City's official zoning map may have had certain
zoning boundary ~tt~jrs that adverscly affe~zted certain property owners in the Rockaway
Beach area; and
WHEREAS, city council believes that the evidence shows that an error
occurred in the zoning boundaries and that the intent has been that the affected parcels
should have been zoned R-2 and not R-0.4 as shown on the current maps;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows:
Section 1. Tax parcels 012402-2-015-2004, 012402-2-022-2005, 012402-2-017-1002,
012402-2-018-2001, and 012402-3-008-2001 and the eastern portion of tax parcels 012402-
2-012-2007, 012402-2-013-2006 and 012402-2-014-2005 shall be corrected on the
comprehensive plan land use map to indicate OSR-2 land use designation.
Seerlore 2. Tax parcels 012402-2-015-2004, 012402-2-022-2005, 012402-2-017-1002,
012402-2-018-2001, and 012402-3-008-2001 and the eastern portion of tax parcels 012402-
2-012-2007, 012402-2-013-2006 and 012402-2-014-2005 shall be corrected on the official
zoning map to indicate R-2 zoning.
Section 3. This ordinance shall take effect on and be in force five days from and after its
passage, approval, and publication as required by law.
