ORD 99-46 CREATION OF ADDITIONAL POSITION ON JOINT HOUSING AUTHORITY BOARDORDINANCE NO. 99-46
AN ORDINANCE of the City of Bainbridge Island,
Washingwn, relating to the creation of an additional
position on the joint housing authority board of
commissioners; and amending Section 2.40.040 of the
Bainbridge Island Municipal Code.
WHEREAS, the City is part of a joint housing authority known as "KitSap
County Consolidatod Housing Authority," as authorized by RCW 35.82.300;
WHEREAS, every housing authority in the State of Washington is authorized to
perform any and all acts necessary or desirable to secure the financial aid or
cooperation of the federal government in the undertaking, construction, maintenance or
operation of any housing project by such authority pursuant to RCW 35.82.200;
WHEREAS, the Kitsap County Consolidated Housing Authority has in the past
and will in the future secure the fmanciai aid and cooperation of the federal
government; .,
WHEREAS, the United States Housing Act of 1937, 42 U.S.C. § 1437, as
amended, now mandates that the membership of the Kitsap County Consolidated
Housing Authority Board of Commissioners shall contain not less than one member
who is directly assisted by the authority;
WHEREAS, the authority to establish the appointment and tenure of the housing
authority' s commission is vested in the legislative authorities comprising the joint city-
county housing authority pursuant to RCW 35.82.300(2);
WHEREAS, the present commission membership requirements must be
amended to include at least one individual who is directly assisted by the authority so
that the Kitsap County Consolidated Housing Authority may continue to secure the
financiai aid and cooperation of the federal government; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Section 2.40.040 of the Bainbridge Island Municipal Code is
amended to read as follows:
2.40.040 Board of comm|~sioners-- Appointment and tenure.
The Kitsap County consolidated housing authority shall be governed by a
board of seven commissioners composed of the following:
A. Elected Officials. The elected members of the board of
commissioners shall be the Board of County Commissioners of Kitsap
County, the Mayor of Port Orchard, Washington, the Mayor of Poulsbo,
Washington and the Mayor of Bainbridge Island, Washington.
1. Appointment to the board of commissioners of the Kitsap
County consolidated housing authority as a result of holding such
elective office shall take effect upon the election and confamation of
office as a county or municipal official. A certificate of appointment or
re-appointment to the board of commissioners of the Kitsap County
consolidated housing authority shall be filed with the clerk of said board
and such certificate shall be conclusive evidence of the due and proper
appointment of such commissioner.
2. Each commissioner shall serve on the board of the Kitsap
County consolidated housing authority during that commissioner' s tenure
as an elected official of the county or municipality respectively, and the
commissioner shall continue to serve on the board until the
commissioner's successor has been appointed.
B. Participant. One individual who is directly assisted by lhe Kitsap
County consolidated housing authority, and who shall be elected by a
majority affffmative vote of the elected officials referenced in subsection
A above, shah serve on the board of the Kitsap County consolidated
housing authority for a term of two years. Such individual participant
board member may be removed from the board at any time by a two-
thirds affin,tative vote by the elected officials referenced in subsection A
above.
Section 2. This ordinance shall take effect and be in force five days from
and after its passage, approval and publication as required by laW.
