ORD 99-31 PROHIBITING SOCIAL CARD GAMES AS COMMERCIAL STIMULANTORDINANCE NO. 99- 3~
AN ORDINANCE of the City of Bainbridge Island, Washington, prohibiting social
card games as a commercial stimulant; and adding a new section 9.21.020 to the
Balnbridge Island Municipal Code.
WHEREAS, RCW 9.46.295 provides that any license to engage in any of the gambling
activities authorized by Chapter 9.46 RCW shall be legal authority to engage in the gambling
activities within a city unless that city specifically prohibits that gambling activity; and
WHEREAS, a nutfiber of establishments conducting social card games as a commercial
stimulant have opened recently in the Kitsap County area; and
WI-IF. REAS, the City Council is concerned about 'the potential negative secondary effects
that such establishments may create that may be detrimental to the public health, safety and
general welfare of the citizens of the City; now therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON,
DO ORDAIN AS FOLI.OWS:
Section 1. A new section 9.21.020 is hereby added to the Balnbridge Island City Code to
read as follows: ,,.-.

Under the authority given the city by RCW 9.46.295, any license issued under the
authority of the State to engage in gambling activities shall be legal authority to
engage in the gambling activities for which it was issued, except that, such a
license is not legal authority to engage in the conduct of social card games, as'
defined in RCW 9.46.0282 as now or hereafter amended, as a commercial
stimulant to business within the City. Any violation of this section is a
misdemeanor.
Section 2. F. ffecfive Date. This ordinance shall take effect and be in force five days from
and after its passage, approval and publication as required by law.
Section 3. Severability,. If any section, sentence, or phrase of this ordinance shall be held
to be invalid or unconstitutional by court of competent jurisdiction, such invalidity or
unconstitutionality shall not effect the validity or unconslitutionality of any other section, sentence,
clause or phrase of this ordinance.
