ORD 99-38 AMENDING COMPREHENSIVE PLAN RE: LAND USE DESIGNATION FOR TAX PARCELSORDINANCE NO. 99-38
AN ORDINANCE of the City of Bainbridge Island,
Washington, mending the City of Bainbfidge Island
Comprehensive Plan Land Use Map changing the land use
designation for tax parcels 222502-1-010-2005, 222502-1-
010-2203, and 222502-1-011-2004.
WHEREAS, on June 30, 1996, Mr. Tom Coultas submitted an application for a
comprehensive plan amendment changing the land use designation from residential to light
manufacturing for two parcels located on New Brooklyn Road; and
WHEREAS, on August 7, 1997, the City Council approved the application for Phase II
processing in accordance with BIMC 18.117; and
WHEREAS, the processing of this amendment request was deferred until an Economic
Element of the Comprehensive was adopted; and
WHEREAS, the Economic Element of the Comprehensive Plan was adopted on January
21, 1999; and
WHEREAS, the Department of Planning and Community Development reviewed and
forwarded its recommendation for approval of the application to the Planning Commission
which held a public hearing on September 23, 1999: and
WHEREAS, the Planning Commission for~varded a recommendation to the City Council to
approve the request. Now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRtDGE ISLAND, WASHINGTON, DO
ORDAIN, as follows:
Section 1. The City Council finds that the Comprehensive Plan Amendment is in
conformance with the comprehensive plan and all applicable state laws in effect at the time
of approval.

Section 2. The City of Bainbridge Island Comprehensive Plan land use map is amended
changing the land use designation on Tax parcels 222502-1-010-2005, 222502-1-010-2203
and 222502-I-011-2004 from OSR-2 to Light Manufacturing (LM); provided that the
required open space will be located predominantly on the south one-half of the property
and the buildings, parking and storage will be located predominantly on the north one-half
of the property.
Section 3. The City Clerk is authorized and directed to file this ordinance for record with
the Kitsap County Auditor, and to file one copy with the recording number with the Kitsap
County Assessor and the applicant.
Section 4. This ordinance shall take effect and be in force five days from and after its
passage, approval and publication as required by law.
