ORD 61-107 IMPOUNDING OF DOGS AND ANIMALS a~ ORDINANCE PRO~IDIi~G FOR THE I~POU~'DING O~ DOGS AND OTHER Ai~IMAL~; ~ETTING THE FEE ~0R REDEi~PTION OF SUCH ANI- ~LS A~D Afi~Ol~TiRG THE KITSA~~ COUNTY HUMANE SOOIETY IAL POUNDMASTER. Be it ordained by the Council of the Town of Winslow: Section 1. KitsaD County Humane Society'- Appointed Found- master. The ~itsap Oounty Humane 5ociety, a corporation ex- isting under ~ection 16.52.020, Revised Code of washington, be and is hereby appointe~ as and declared to 0e the official poundmaster of the Town of winslow commencing September l, 1961. Section 2. foundmaster - ~uties. The Poundmaster shall ~n- pound all animals subject to impounding as lrescribed 0y' Town o~dil~ance, and such anhaals shall be provided with proper care, feed and water while so confined. The ~oundmaster shall col- lect and dispose of all dead animals found in the Town, a~d if the owner is ~nown a fee of $2.00 may be collecte~ therefrom for such services. All sick or injured animals shall be im- pounded when not in the o~ner's possession and may be humanely destroyed at the discretion oI the .i~oundmaster; provide~, that the ~:oun~master shall immediately notify the owner, if the owner is ~nown, and if the owner be ~n~nown, make all reasona'01e ef- fort to loc~te an~ n~tify the owner. ~ection 3. ~oundmaster ,~ployees - To Be Special Police. Each employee of such Poundmaster over the age of 21 years, except clerks and stenographers, is hereby made a special po- lice officer, or marshall, and charged with the duty of enforc- ing all ordinances of the Town of Winslow relating to the con- trol, care, treatment and impounding of animals, but without pay from the Town treasury; provided, the said employees are first sworn in and provided with a suitable badge of authority furnished by the Town of Winslow, and to 0e withdrawn from said officer at any time by a ~ote of the majority of the Town Coun- cil present at any meeting of the Council. Section ~. Interference with ImpoundinN. It shall be unlaw- ful for any person to interfere with, hinder, delay or impede any officer in the enforcement oi this ordinance and such ~io- lation shall be punishable by a fine not exceeding $~00.00 o~/~ by both such fine and imprisonment. Section 5. Notice of Impounding. Upon any dog or other ani- mal being impounded under the provisions of this ordinance, the impounding authority shall as soon as feasible notify the owner, if the owner is known, of the impounding of such dog or other animal, and the terms upon which said dog or other animal can be redeemed. If t~e owner of said dog or other animal so impounded is unknown, then said impounding authority should make all reas- onable effort to locate and notify the owner of the impounding of said dog or other animal. Section 6. Redemption of Dog. The owner of any dog impounded under this ordinance may redeem it within forty-eight hours from time of impounding by paying to the impounding authority a ser- vice charge of $3.00, together with any unpaid license fee for said dog. If such dog is not redeemed by the owner within forty- eight hours, than any person may redeem it within the next forty- eight hours by complying with the above provisions, and in case such dog is not redeemed at the end of such time, it may be hu- manely destroyed or otherwise disposed of within the discretion of the impounding authority. If sa~d dog is held for more than forty-eight hours, an ad- ditional charge of not to exceed $1.00 for each day in excess of forty-eight hours may additionally be imposed. Such additional day shall begin at l:O0 A. M. on the third day after the impound- ing of said do~. Section 7- Redemption of Cat or Other Animal. The owner of any cat or other animal impounded under the provisions of this ordinance may redeem it within forty-eight hours from the time of impounding by paying to the impounding authority a service charge of $3.00. If such cat or other animal is not redeemed 'by the owner within forty-eight hours, it may be h~nanely de- stroyed or otherwise disposed of within the discretion of the impounding authority; provided, however, any cat or other ani- mal so impounded less than two months of use, at the discretion of the impounding authority, may be humanely destroyed or other- wise disposed of at an~ time ater impounding. Section 8. Redemption of Horse, Cow, Goat or Other Livestock. The owner of any horse, cow, goat or other liwestock may redeem it within 72 hours from the time of impounding by paying to the impounding authority a fee of $1.50 for each day or part there- of that animal is detained, plus an impounding fee of $3.00 which shall include care and feeding for the day impounded. An additional fee of $7-50 shall be paid the Poundmaster for trans- portation of larger animals requiring the use of special equip- ment for impounding. Section 9. Sale of Unclaimed Horse, Cow, Goat or Other Livestock. Any horse, cow, goat or other livestock not claimed and released upon required payment shall at the expiration of 72 hours be sold at public auction upon lO day's notice pub- lished in the Town official newspaper setting forth the time and place ~nd name of owner, if known, and if unknown, so stat- ing. A copy of such ~otice shall be served upon the owner, if ~nown to the Poundmaster and can be found in the Town, at least one day before the sale. The Poundmaster shall deduct from the proceeds of sale all expenses of feeding and caring for said animal and all e~penses of advertising and selling the same, and shall retain the balance in reserve for six months from date of sale, and if unclaime~ a t the expiration of such period it shall revert to the Poundmaster for operation ~ of the pound. No such money shall be paid any claimant except upon proof satisfactory to the Poundmaster that he is entitled to the same. PASSED this ~ ~ day ° -- 1961. Attest: TOWN OF WINSLOW
