A RESOLUTION OF THE CITY OF WINSLOW, A MUNICIPAL COR-
PORATION, KITSAP COUNTY, WASHINGTON~ RELATING TO AND
PROVIDING FOR THE ACQUISITION BY NEGOTIATION OF
RIGHTS-OF-WAY FOR SEWER PURPOSES OVER AND ACROSS
CERTAIN TRACTS OF LAND IN KITSAP COUNTY, WASHINGTON,
ALL AS MORE PARTICULARLY DESCRIBED IN THIS RESOLUTION,
AND PROVIDING FOR PAYMENT THEREFOR.
THE CITY COUNCIL OF THE CITY OF WINSLOW DO RESOLVE AS
FOLLOWS:
Section 1. That public necessity and convenience demand
that a right-of-way for sewer purposes be acquired over and across
the real property situated in Kitsap County~ Washington, all as
more particularly described in Exhibits attached hereto and by
this reference incorporated herein as if set forth at this point.
Section 2. That the City Attorneys, Beresford, Booth, Lehne,
McKisson & Baronsky, are hereby authorized to commence negotiations
with the property owners of record of the property described in
exhibits hereto for the acquisition of such rights as are required
and that they are authorized to pay therefor such sums as are
specified in that certain Employment Agreement dated March 15, 1976-
Section 3. In conjunction with the negotiation for said
properties the City promises and covenants that in connection with
any construction, repair, or alteration of the sanitary sewers to
be constructed on the said easements, the same shall be accomplished
in such a manner that the private improvements existing in the
said easements shall not be disturbed or destroyed~ or in the event
they are disturbed and destroyed, they will be replaced in as good
condition as they were immediately before the property was entered
upon by the City, its agents, or its contractors.
Section 4. The entire cost of the acquisition of said land
shall be paid from the City of Winslow Sewer Construction Fund.
Section 5. That this resolution shall be effective immediately.
PASSED this 15th day of March, 1976 by the City Council of the
City of winslow.
