RES 82-01 IMPROVEMENTS TO ALDER AVENUECITY OF WINSLOW, WASHINGTON
RESOLUTION NO. 82-01
A RESOLUTION Of the City Council of the City of
Winslow, Washington, declaring its intention,
pursuant to property owners' petition therefor, to
construct and install certain street, water and
sanitary sewer improvements for Alder Avenue and
Dingley Road within the City and to create a local
improvement district to assess the cost and expense
of carrying out such improvement against the
property specially benefited thereby; and notifying
all persons who desire to object to the improvement
to appear and present their objections at a hearing
before the City Council.
WHEREAS, a petition has been filed with the City Council
signed by the owners of property aggregating a majority (1) of the
lineal frontage upon the improvement, and (2) of the area within the
proposed district, setting forth the nature and territorial extent
of the proposed improvement, the mode of payment and what portion of
the lineal frontage upon the improvement and of the area within the
proposed district is owned by the petitioners as shown by the
records in the office of the County Auditor of Kitsap County,
Washington, petitioning for the development of the north 750 feet of
Alder Avenue and that portion of Dingley Road lying between the
westerly margin of Alder Avenue and the westerly edge of the
existing pavement of Park Avenue as per the plat of Madrona Park
Heights as recorded in Volume 3 of Plats, Page 59, Records of Kitsap
County~ Washington, including the construction and installation of
water mains, storm sewers, sanitary sewers and a paved residential
access street; and
WHEREAS, Charles MacLearnsberry, consulting engineer for
the City~ has determined and certified to the City that the petition
is sufficient and the facts therein set forth are true; and
WHEREAS, the City Council has determined it to be in the
best interest of the City and of the owners of the property within
the local improvement district that such improvement petitioned for,
as hereinafter described, be carried out and that a local improve-
ment district be created in connection therewith, and that a public
hearing to be held prior to ordering such improvement and estab-
lishing such local improvement district; NOW~ THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WINSLOW,
WASHINGTON, as follows:
Section 1. It is the intention of the City Council of the
City of Winslow, Washington, pursuant to property owners' petition
therefor, to order the improvement of the property described in
Exhibit A~ attached hereto and by this reference made a part hereof,
by the development of the north 750 feet of Alder Avenue and that
portion of Dingley Road lying between the westerly margin of Alder
Street and the westerly edge of the existing pavement of Park Avenue
as per the plat of Madrona Park Heights as recorded in Volume 3 of
Plats~ Page 59, Records of Kitsap County, Washington, including
water mains, storm sewer, sanitary sewer and a paved residential
access street. The improvements shall include the acquisition of
property easements and rights-of-way necessary to carry out the
above improvements.
All of the foregoing shall be in accordance with the plans
and specifications therefor prepared by Charles MacLearnsberry,
consulting engineer for the City.
Section 2. The total estimated cost and expense of the
improvement is declared to be $182,050. The entire cost of the
improvement shall be borne by and assessed against the property
specially benefited by such improvement to be included in a local
improvement district to be established embracing as near as may be
all property specially benefited by such improvement.
Section 3. All persons who may desire to object to the
improvement herein described are notified to appear and present such
objections at a meeting of the City Council to be held in the City
Hall, 625 Winslow Way East, Winslow, Washington, at 7:30 p.m., local
time, on __~c_h__~ ........... , 1982, which time and place are fixed
for hearing all matters relating to the proposed improvement, and
all objections thereto, and for determining the method of payment
for that improvement.
Section 4. Charles MacLearnsberry, the City's consulting
engineer, is directed to submit to the City Council, on or prior to
the day fixed above for the hearing, all data and information
required by law to be submitted.
Section 5. The City Clerk-Treasurer is authorized and
directed to publish this resolution in at least two consecutive
issues of a newspaper of general circulation within the City, the
first publication to be at least fifteen days before the day fixed
for the hearing. The City's consulting engineer is authorized and
directed to give notice of the hearing set hereinabove by mail at
least fifteen days before the day fixed for the hearing to the
owners or reputed owners of all lots, tracts and parcels of land or
other property to be specially benefited by the proposed improvement,
as shown on the rolls of the Kitsap County Treasurer, directed to
the address shown thereon, which notice shall also set forth the
nature of the proposed improvement, the estimated cost and the
estimated benefits of the particular lot, tract or parcel.
ADOPTED by the City Council of the City of Winslow,
Washington, and approved by the Mayor, at a regular open public
