A RESOLUTION OF THE CITY OF WINSLOW REMOVING
RESTRICTIVE COVENANT FROM PROPERTY LOCATED
AT 216 ERICKSEN AVENUE NE, KNOWN AS BRUCE
BRUNTON'S ERICKSEN STREET OFFICE BUILDING;
AND
WHEREAS, the building located at 216 Ericksen Avenue NE
is in a commercial zone and is classified as a type B2 building
by the 1979 Uniform Building Code, 1979 Edition.
WHEREAS, the 1979 Uniform Building Code at Section (104b)
requires fire retardant rooves for group B2 building; and
WHEREAS, the property owner applied an approved fire
retardant chemical treatment to the roof that substantially
brought the roof into compliance with the requirement of the
UBC; and
WHEREAS, this chemical treatment must be reapplied every
10 years to continue UBC compliance; and
WHEREAS, the Covenant filed on July 11, 1980 setting forth
certain building set backs is no longer required.
NOW THEREFORE, BE IT RESOLVED THAT:
The City of Winslow releases Bruce Brunton and Margaret Ann
Brunton from the provisions of the covenant number 8007110007 on
tax account number 262502-3-021-200 which is property legally
described as follows:
That portion of Section 26, Township 25 North, Range 2 East,
W. M., described as follows:
Beginning at a post 372' North of a post which is 999' East
of the SW corner of the North 1/2 of the SW 1/4 of said
Section 26, thence running North 98', thence East to the rim
or top of the ravine; thence Southerly along the rim or top
of the ravine to a point East or to the point of beginning;
thence West to point of beginning. Situate in Kitsap County,
Washington. Tax Account #262502-3-021-200
Said covenant is attached hereto and made part here of:
The fire retardant treatment shall be considered adequate to
meet the provisions of section 104(b) of the 1979 UBC for a period
f 10 years; and
The roof must be treated again prior to 10 years from the
date of application which was September 14, 1982 or use of
RESOLUTION NO. 83-17

building for commercial purposes shall be discontinued until
replacement of the roof or reapplication of an approved fire
retardant material is accomplishhed.
PASSED by the City Council of the City of Winslow this
December 15 , day of 1983.
