RES 84-21 KC FIRE PROTECTIONRESOLUTION NO. 84-21 A RESOLUTION OF THE CITY OF WINSLOW, WASHINGTON, DESIGNATING KITSAP CO~TY FIRE PROTECTION DISTRICT #2 AS THE HAZARDOUS MATERIALS INCI- DENT CO~D AGENCY WITHIN ITS RESPECTIVE BOUNDARIES, AND AUTHORIZING THIS FIRE PROTEC- TION DISTRICT TO ACCEPT ~TUAL ASSISTANCE BETWEEN THE FIRE PROTECTION DISTRICT AND PER- SONS WITH EQUIPMENT, PERSON~IEL, AND EXPERTISE, IN THE HANDLING OF HAZARDOUS P~TERIALS INCIDENT BY ESTABLISHING LIMITATIONS ON LIABILITY FOR THOSE PERSONS RESPONDING UPON REQUEST OF THE INCIDENT CO~ND AGENCY. WHEREAS, City of Winslow may designate a Hazardous Materials Incident Conmand Agency according to Chapter 70,136.030 RCW, and ~-IEREAS, designated Hazardous Materials Incident Command Agencies are authorized and encouraged, prior to a hazardous materials incident, to enter individually or jointly into hazardous materials emergency assistance agreements with any person whose knowledge or expertise is deemed potentially useful, and I~HEREAS, any person show, in good faith, renders emergency care, assistance, or advise with respect to a hazardouw materials incident is not liable for civil damages resulting from any act or omissions constituting gross negligence or wilful or wanton mis- conduct now, therefore, BE IT RESOLVED, as follows: SECTION 1. That the City Council of the City of Winslow, Washington, hereby designates Kitsap County Fire Protection District ~2 as the Hazardous Materials Incident Command Agency for hazardous materials incidents within the boundaries of Fire Protection District #2 SECTION 2. The Fire Chief or his designated representative is authorized to enter into agreements with persons, agencies, and/or corporations who may provide assistance with respect to a hazardous materials incident, in accordance with the provisions of Chapter 70.136,060 and 70,136,070 RCW. SECTION 3. Now, therefore, in accordance with Chapter 7~.136 RCW and by reason of the facts above stated there exists, and is hereby declared to exist, an emergency; and this resolution is nece- SSary for the immediate preservation of the public peace, health and safety of the citizens of the City of Winslow and shall be in full force and effect immediately upon passage and publication.
