A RESOLUTION OF THE CITY OF WINSLOW,
WASHINGTON, ORDERI~]G SEGREGATION OF
SPECIAL ASSESSMENTS FOR LID 3D-4.
The City Council of the City of Winslow, Washington,
resolves as follows:
The City Council determined on March 21, 1985, that the
segregation requested by Russell Freeman on his letter
dated March 13, 1985 (Exhibit A) for the property known
as the "Russell Freeman Short Plat" dated December 4, 1984,
shown on attached Exhibit B, be made and the City Treasurer
shall make the segregation ordered hereby on the original
roll.
2. Amount and date of the original assessment is as follows:
Original Assessment: $9,158.45
Roll Date: April 7, 1980
Property Tax Number: 4120-000-001-0006
Amount due to the City for reasonable engineering and
clerical costs together with $10.00 for each tract of
land for which segregation is made: $65.00

Boundaries of the divided parts are shown on Exhibit B,

is: $6,778.23.

SUBJECT: Reapportionment of Sewer LID assessment to short plat division of
properties.
We are in the final phases of shortplatting the property located between
Yeomlt Point Drive and Dingley Avenue. It is that property described legally
as:
the east half of lot 1, Yeomalt Point, Vol~ne 3, page 5 of records of
Kitsap County.
Currently the assessment is levied against the entire piece of'property.
In order for us to market the property, we would like to reallocate the
assessment over the four lots with this formula:
1/6 each to lots 1, 2, and 3 and 1/2 to lot 4.
This would be in accordance with a copy of the map from the short plat
application, a copy of which is attached.
Time is of the essence. The residence currently existing on lot i has
bee~sold with the closing date set for April 30, 1985. It is the desire of
the purchaser that there be no encumbrances:or leins.

Inasmuch as the total paid to date more than equals the 1/6th allocation
to Lot #1 ($1,526.41) we request that subsequent to approval of the
reallocation that a letter be issued by the City that lot #1 is deemed to be
free and clear of all sewer assessments allocated thereto. Said letter would
then be filed with other legal documents pertaining to the sale.
We request this item be included as part of your agenda at the next
regular Council meeting, March 21.

=Every short plat application filed for record must contain a
statement ~iving a description of the lands divided as they appear
on the short plat, including a statement that the short subdivision
· has been made with the free consent of and in accordance with the

If the short plat contains a dedication, then the statement shall
also contain the dedication of all streets and other areas to the
public and a waiver of all claims for damages against any
governmental authority which may be occasioned to the adjacent land
