RES 85-19 PERSONNEL MANUALWDT: j t 8/12/85 RESOLUTION NO. 85-19 A RESOLUTION OF THE CITY OF WINSLOW, WASHINGTON, REVISING THE CITY'S PERSONNEL MANUAL. WHEREAS, pursuant to Resolution No. 84-12 the City Council on May 17, 1984, the City Council personnel manual for the City and __, passed by adopted a change in therefore, WHEREAS, the United States Supreme Court has required a the City's Personnal policies and practices, now, THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. That portion of the Personnel Manual contained in Section 4 is hereby amended to read as set forth in the attached Exhibit A, attached hereto and incorporated herein by this reference. Section 2. TAWRESE~ September 5, 1985 SeDtember 5, 1985 EXHIBIT A Section 4: Compensation & Benefits Work Day and Work Week 1. Except for police officers, the regular work week consists of ~0 hours within 7 consecutive 24-hour periods. For police officers the regular work period shall consist of 160 hours within a 28 day work period. 2. Except for police officers, the regular work week begins just after midnight Saturday mornin9 and ends at midnight the followin9 Friday night. The work week for police offi- cers shall be specified by the Chief. 5. The work week and work schedule are specified in the employee's job description or are assigned by the employee's department head. 4. Rest periods of not less than 10 minutes shall be scheduled for each four hours of working time. However, where the nature of the work allows employees to take intermittent rest periods equivalent to 10 minutes for each ~ hours worked, scheduled rest periods are not required. 5. Modification of an employee's work schedule may be made only with the approval of the department head. 6. Included in work hours are: Dealin9 with the public, workin9 on City property, workin9 in City facilities, working with City equipment, police officers' court appearances, respondin9 to emergency calls, drivin9 time for attendin9 conferences or meetings in other cities. Two fifteen minute work breaks as determined by the department head. Not included in work hours are: Time spent in City or personal vehicle drivin9 to or from work daily. "Standing by" or "on call" time where the employee can follow his own pursuits, meal breaks of 50 minutes or more. Adjusted Schedule 1. The department head may require an employee to adjust his/her schedule within an individual work period. A sche- dule adjustment may be made to better accommodate the work load and/or to not require an employee to work more than 40 hours in one work period. (Pollce officers' work perlod is 160 hours within 28 days.) 2. Notification of a schedule adjustment should be given to the employee at the earliest convenient time. 5. Employees who must work an adjusted schedule will not receive overtime or compensatory tlme as long as the hours in the work period do not exceed 40. (Except for police.) If an employee is required to work on a day observed as a City holiday, the employee will accrue 8 hours of time for the holiday plus regular time for any hours worked during that day. A schedule adjustment may be requlred if the employee wlll accumulate more than the number of hours in the employee's work week unless overtime ls authorized. Overtime l. Prior approval required. Overtime may not be worked without the express prior appro- val of the department head. Any such overtime worked with- out prior approval is not authorized and will not result in compensatory time or overtime pay, whichever is applicable. In an emergency situation where prior approval is not possi- ble, the approval shall be obtained at the earliest possible time following the overtime worked. 2. Employee eligibility for overtime compensation. a. Employees who are not "exempt-employees" as defined in this Personnel Manual shall be paid 1.5 times their - 2 - regular hourly rate for authorized overtime, unless they receive prior compensatory time approval from their suprervisor. Compensatory time shall be 1 1/2 hours for every hour of authorized overtime. Approved compensa- tory time must be taken within the employee's pay period and must otherwise conform with applicable state and federal law. b. "Exempt employees" as defined in this Personnel Manual will be reimbursed for overtime worked in time accrued at the rate of one (1) hour comp time for each hour of authorized overtime worked. c. Certain exempt employees, in accordance with City policy, will be reimbursed for overtime at the rate of 1.5 times their regular hourly rate for authorized over- time worked. These employees are limited to the Mainte- nance Supervisor and the Police Chief. Any compensatory time or other hours credited toward annual leave shall be considered "leave" once credited and will be subject to all regulations which apply to annual leave. Effect of Leave on Work Week Any authorized leave shall be considered the same as hours worked in determinin9 the number of hours worked in a week. Record of Annual Leave The payroll clerk will maintain an annual leave and compen- satory leave time record. This record will be distributed monthly to the Mayor, the Council Personnel Committee, and applicable sections to each department head. Annual Leave No more than 160 hours of annual leave may be accumulated at any time. The Mayor may grant a variance to this rule on a - 3 - case-by-case basis. In the event a variance is granted, the accumulation of hours above 160 must be used prior to the end of the same calendar year. Employees who, at the date of adoption of this resolution, have an excess of 160 hours of leave accumulated will have until January 1, 1986, to use up accumulated hours. Probationary employees are not eligible for annual leave until the end of the probation period, although credit will accrue from the beginning of employment. For the purposes of determining eligibility for annual leave only, police offlcers shall be deemed to have completed thelr probationary period after three months.
