January 16, 1973 MEMORANDUM To: From: Subject: Mayor, City of Winslow City Attorney Town of Winslow Ordinance 133/Mayor's Letter of 12/26/72 Town of Winslow Ordinance 133, S49(a) prohibits riding bicycles on the sidewalk within a business district. By S49(b) the Town Marshal, on approval by the Town Council, is authorized to erect signs prohibiting - ~ding bicycles "thereon". ~49(c) makes provision for riding bicycles )n sidewalks and requiring the rider to yield the right-of-way to a o~destrian. The ordinance can probably be construed to make sense if subparagraphs (~ and ~ of ~49 are considered to refer to other than business district sidewalks. Probably a citation for a misdemeanor charging violation of ~49 would be appropriate if issued to a person riding on the sidewalk within the business district even though no signs had been erected as contemplated by subparagraph (b) - probably for non-business district sidewalks.
