RES 88-13 GREENHOUSE HILL APPEALRESOLUTION NO. 88-13 A RESOLUTION ADOPTING THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, FINDING OF FACTS, CONCLUSIONS OF LAW AND DENIAL OF APPLICATION IN THE MATTER OF THE GREENHOUSE HILL APPEAL. WHEREAS, this matter came before the City Council of the City of Winslow, Washington, on April 21, 1988, at 7:00 P.M. for consideration of an appeal. At issue was whether a conditional use permit should be granted to allow commercial parking north of Winslow Way East and Ferncliff Avenue, and whether the development proposal meets the applicable planned unit development criteria; and WHEREAS the appeal hearing was concluded, NOW THEREFORE, the City Council of the City of Winslow, Washington hereby resolves as follows: Section 1. TAWRESEY, Mayor Before the City Council CITY OF WINSLOW In the Matter of the ) Greenhouse Hill PUD ) Application for a Planned Unit ) Development/Conditional Use Permit, ) New Bainbridge ) Development Partnership, Applicant ) File No. 10-01-87-1 FINDINGS OF FACT, CONCLUSIONS OF LAW, AND DENIAL OF APPLICATION This matter came before the city council for the City of Winslow, on April 21, 1988 at 7:00 P.M. for consideration of an appeal. At issue was whether a conditional use permit should be granted to allow commercial parking north of Winslow Way East and Ferncliff Avenue, and whether the development proposal meets the applicable planned unit development criteria. Applicant was represented by Wilbur and Dorothy Nystrom, attorney David Bendell of Sequim, Wa., and representatives of New Bainbridge Development Partnership, including architect Miles Yanick. The appeal hearing was concluded. The council having voted in open session 3 - 2 to deny the application, pursuant to Winslow City Code Section 2.16.070 and 2.16.080, it now, in order to demonstrate its reasons for denial, From the testimony, the exhibits admitted and the exhibits within the public file, makes following: at the hearing, and enters the FINDINGS OF FACT 1. Those findings of fact Hearing Examiner filed March 3, city council's findings of fact. made by the City of Winslow 1988 shall be adopted as 2. The decision of the Hearing Examiner to deny the Conditional Use Permit shall be affirmed, for the reasons set forth in her opinion of March 3, 1988. 3. The recommendation of the Hearing Examiner to deny the Planned Unit Development is accepted and affirmed, for the reasons set forth in her opinion of March 3, 1988. From the Foregoing, the Council makes the following: CONCLUSIONS OF LAW Based on the conclusions set forth by the Hearing Examiner in her opinion of March 3, 1988, which shall be adopted as city council's conclusions, the application should be denied.
