A Resolution of the City Council of the City
of Winslow to Establish a Hearing to Vacate
Certain Portions of a Sixteen-Foot Alley
Starting at Madison Avenue, as shown on a
Plat for Winslow Business Addition recorded
in Vol. 7 of Plats, Page 38, Records of
Kitsap County.
WHEREAS, by petition or resolution, the City of Winslow may
consider the vacation of streets and alleys, pursuant to RCW
35.79, and
WHEREAS, the City may declare certain public lands or the
rights thereto surplus and otherwise establish any benefits to be
conferred from a vacation, exchange or transfer of same, and
WHEREAS, the City Clerk has received the requisite petition
and/or requests to vacate certain portions of a sixteen-foot al-
ley located in the City adjacent to the bowling alley, and run-
ning from Madison Avenue east-west some two hundred feet, and
then running north-south to a point on Madrone Lane, as shown on
a plat for Winslow Business Addition recorded in Vol. 7 of Plats,
Page 38, Records of Kitsap County, and
WHEREAS, the City was willing to undertake the statutory
process for considering the vacation of certain portions of said
alley by petition and resolution as being in the best interests
of the public,
NOW, THEREFORE, Be It Resolved that the City of Winslow
herewith adopts the following as and for its official deeds and
acts:
1. the City shall formally consider and hear public views
at City Hall Council Chambers concerning the petition and/or
requests for vacation of the sixteen-foot alley, at 7 p.m. on the
15th day of December, 1988, which alley is shown on a plat for
Winslow Business Addition recorded in Vol. 7 of Plats, Page 38,
Records of Kitsap County;
2. the portions of said sixteen-foot alley to be hereafter
considered for vacation by ordinance shall consist of: that part
between the Bowling Alley property (Tax Lot No. 262502-3-067-2009)
and the Kerr property (Tax Lot No. 262502-3-065-2001) 200 feet, more
or less, East from Madison Avenue, thence North 115 feet, more or less,
to the Southeast corner property line of the Jiffy Mart property
(Tax Lot No. 262502-3-064-2002);
3. in the event of approval by Council and the finding it
ms for the common benefit, an ordinance approving such vacation
to the extent it is considered in the public interest then shall
be adopted, apportioning the rights therein as provided by
statute; and
4. the City Council finds that such proposed vacation of
the portions of the sixteen-foot alley to be hereafter considered
are prima facie surplus to the needs of the City and the public;
and
5. the City Council finds that considering the proposed
exchanges of property and the benefits to be derived in connec-
tion with such vacation, they appear to be at least equal in
value or in favor of the public than what the public would be
vacating.
RESOLVED BY THE CITY COUNCIL of the City of Winslow,
Washington, this 23rd day of November , 1988.
