RES 89-46 IMPROVEMENT OF HIGH SCHOOL ROAD VIA LIDCITY OF WINSLOW, WASHINGTON RESOLUTION NO. 89-46 ARESOLUTION of the City Council of the City of Winslow, Washington, declaring its intention to order the improvement of a portion of High School Way within and without the City and to create a local improvement district to assess a part of the cost and expense of carrying out that improvement against the properties specially benefited thereby; notifying all persons who desire to object to the improvement to appear and present their objections at a hearing before the City Council to be held on October 12 , 1989; and repealing Resolution No. 8940. WHEREAS, by Resolution No. 8940 adopted August 21, 1989, the City Council declared its intention to order the improvement of a portion of High School Way within and without the city and to create a local improvement district to assess a part of the cost and expense of carrying out that improvement against the properties specially benefited thereby, and fixed October 1989 at 7:00 p.m., local time, in the Council Chambers of the City Hall as the time and place for hearing all matters relating to the proposed improvement and local improvement district~ and WHEREAS, in order to give due notice by publication of the hearing on that proposed improvement and local improvement district as in the manner required by law, it is necessary for the City Council to reschedule that hearing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WINSLOW, WASHINGTON, as follows: Section 1. City of Winslow, It is the intention of the City Council of the Washington, to order the improvement of the - 1 - properties within the area described in Exhibit A attached hereto and by this reference made a part hereof, by the construction of improvements to High School Way between Madison Avenue and Ferncliff Avenue, as more particularly described in Exhibit B attached hereto and by this reference made a part hereof. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by Roats Engineering, consulting engineers, and may be modified by the City as long as that modification does not affect the purpose of the improvements. Section 2. The total estimated cost and expense of the improvements is declared to be $1,400,465, approximately $166,360 of which shall be paid by the City and the balance of which shall be borne by and assessed against the property specially benefited by the improvements to be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvements. Actual assessments may vary from estimated assessments as long as they do not exceed a figure equal to the increased true and fair value the improvements add to the property. Section 3. All persons who may desire to object to the improvements are notified to appear and present those objections at a hearing before the City Council to be held in the Bainbridge T~l~n~q~ni~r C~nter, 370 Bj~ne Drive SE in Winslow, Washington, - 2 - at 7:00 ~.m. on Thursday, October 12, 1989 , which time and place are fixed for hearing all matters relating to the improvements and all objections thereto and for determining the method of payment for the improvements. All persons who may desire to object thereto should appear and present their objections at that hearing. Any person who may desire to file a written protest with the City Council may do so within 30 days after the date of passage of the ordinance ordering the improvements in the event the local improvement district is formed. The written protest should be signed by the property owner and should include the legal description of the property for which the protest is filed and that protest should be delivered to the City Clerk-Treasurer. Section 4. Roars Engineering is directed to submit to the City Council on or prior to October 12, 1989, all data and information required by law to be submitted. Section 5. Resolution No. 8940 is hereby repealed. The foregoing resolution was ADOPTED by the City Council of the City of Winslow, Washington, at a regular open public meeting thereof this 21st day of September, 1989. The project will include construction of water, sanitary sewer, storm sewer, underground power and underground telephone. Concrete curb, gutter and sidewalk will be constructed on both sides of the road the length of the project as well as landscaping within the right of way. Storm drainage pipes will also be constructed downstream from Sakai~s Pond, under High School Road and under SR 305.
