Wash ington;
SECTION 1. ~doption of Fire Prevention Code.
There is hereby adopted by the To~n of Winslow for the purpose
of prescribing regulations governing conditions hazardous to life
and property from fire or explosion, that certain code known as the
Wire Frevention Code, Abbreviated Edition, reconmended by the Nat-
ional Board of 31re Undem~riters, being particularly the 1960
edition thereof and the whole thereof, save and except such portions
as are hereinafter 'I~e!eted, modified or amended, of which code not
less than three (3) copies have been and now are filed in the office
of the cle ck of the Toyan of Winslow and the same are he~oby adopted
and incorporated. as fully as if set out at length herein, and from
the date on which this ordinance shall take effect, the provisions
thereof shall be controlling ~nLthin the limits of the To~m of Winslow,

SECTIOiq 2. Enforcement. The code hereby adopted shall be enforced by
the Fire Liarshal of the Town of Winslow.
SECTZOiq 3- Definition. ~laerever the word '~unicipality" is used in
the code hereby adopted, it shall be held to mean the Tm~m of Winslow~
~.~¢ashinSton.
Wherever the words "Chief of Fire Department" are used in the
code hereby adopted, they shall mean the Fire 1./~arshal of the Tovm of
Winslow or his authorized deputy.
Establishment of Limits of Districts in which Storage
of Fla~mable Liquids in Outside Abovegroun~ Tanks, Bulk
Storage of Licuified Petroleum Gases and Storage of Ex-
olosives and ~lastin~ A~ents is to be Restricted.
The li~its referred to in section 73 of the code hereby adopted
in ~nich storaZe of fla~aable liquids in outside aboveground tanks is
prohibited, the limits referred to in section 103 of the code hereby
adopted, in which bulk storage of liquified petroleum gas is restricted,
and the lh~ts referred to in section %3b of the code he~ebyadopted~
i~ which storage of explosives and blasting agents is prohibited, are
hereby established as follows: that area lying vdthin the incorporated
limits of the Tovm of Winslow~ ~'lYashington.
gECTiON ~. ~]odifications. The Fire Earshal shall have power to mod-
ify any of the provisions of the ~ode hereby adopted upon application
in writing by the order or lessee, or his duly authorized agent, ~en
there are practical difficulties in the ~y of carrying out the strict
letter of the code, provided that the spirit of the code shall be ob-
served, public safety secured, and substanl Lal justice done. The
I~rticulars of such modification v~en granted or allowed and the deci-
sion of the Fire ~arshal thereon shall be entered upon the records of
the department and a si~ned copy shall be furnished the applicant.
SECTICN 6. Appeals. YSmnever the Fire Marshal shall disapprove an
application or refuse to !irant a permit applied for, or when it is
claimed that the provisions of the code do not apply or that the true
intent and meaning of the code have been misconstrued or ~wfongly in-
terFered, the applicant may appeal from the decision of the Fire
Marshal to the Town Council of the Town of Winslow within 30 days from
the date of the decision appealed.
SECTION 7- Penalties. (a) Any person who shall ~iolate any of the
provisions of the code hereby adopted or fail to comply therewith, or
~Yno shall violate or fail to comply with any order made thereunder,
or who shall build in violation of arF detailed statement of specif-
ications or plans submitted and approved thereunder, or any certif-
icate or peT. nit issued thereunder, and. from which no appeal has been
taken, or vdqo shall fail to c~!mply ~.dth m~.ch an order as affiemed or
modified by the Town of Winslow or by a court of competent jurisdic-
tion, within the time fixed herein~ shall severally for each and every
such violation and noncompliance respectively, be [;~uilty of a ~rXsdeam-
eanor~ punishable by a fine of not more than ~100.50 or by imprison-
mcnt for not more than 30 days or by both such fine and imprisonment.
The i~nposition of one penalty for any violation ~j~alt not excuse
violation or permit it to continue; and all such persons shall be re-
quired to correct or remedy such violations or defects vithin a reason-
able time; and when not othem~ise specified, each ten days that pro-
hibited conditions are maintained shall constitute a separate offense,
(b) The application of the above penalty shall not be held to
prevent the ePfforced removal of prohibited conditions.
SECTION 8. Repeal of Conflicting Ordinances. Ordinance No. 122 and
all fo.rm..er ordinances or parts thereof conflicting or inconsistent
with the i~ovisions of this ordinance or of the code hereby adopted
are hereby repealed.
SZCTION 9. Validity. IFne Tom of Winslow hereby declares that should
any section, paragra~, sentence, or word of this ordinance or of the
code hereby adopted be declared for any reason to be invalid, it is
the intent of the Tovm of Winslow that it would have tsssed all other
portions of this ordinance independent of the elimination herefrom of
a~ sn~chr~ortion as may be declared invalid.
S..~CTiON i0. Date of Effect. %~is ordinance is declared to be one
necessary for the immediate preservation of the public peace~ property~
health and safety c~ the people of the Town of Winslow~ Washington.
An emergency is her~by~eclared to exist, and this ordinance is hereby
~eclared to be in f~l]. force and effect from and after it's passage,
approval and publication as provided by law.
