A RESOLUTION OF THE CITY OF BAINBRIDGE ISLAND,

Architect and Planner and authorizing a process to plan waste water
treatment options for the south part of the island in cooperation with Sewer
District #7.
WHEREAS, there is an urgent health and environmental need to remedy certain existing
on-site septic system failures;
WHgREAS, there is an opportunity to derive public benefit in the form of habitat
protections, public trails, open spaces, clustering and affordable housing by offering
sewer treatment to areas where development is planned or already approved;
WHEREAS, Sewer District No.7 Resolution No. states that it will consider
offering sewer treatment for areas outside the district if and only if: there is no cost to in-
district residents; sewer treatment will not increase current zoned density; and if the
properties meet one of the following conditions: 1) that sewer treatment is needed to
solve an environmental or health emergency; or 2) that sewer treatment will result in
some public benefit;
WHEREAS, implementing this study will result in the least costly solution in the long
term for the treatment of the area's waste water;
WHEREAS, Sewer District No.7 wastewater plant has BOD, TSS and outfall capacity to
handle an additional flow of 40,000 GPD (approximately 150 equivalent hookups); and
WHEREAS, a public process is required before the City decides whether to implement
any sewer treatment agreement with property owners or Sewer District No.7.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES RESOLVE AND DIRECT AS FOLLOWS:
Section 1. The City Council of the City of Bainbridge Island accepts the Report
dated May 19, 1999 fi:om Rick Esvelt and William Isley.
Section 2. The City Administration is directed to develop the general sewer.
service plan and a plan to promptly remedy existing failing septic systems as outlined in
the Esveltasley report and under State law. The Administration is further directed to
prepare a description of the process for the information of Council and the public.
Section 3. The City Administration is authorized to request proposals for a
General Sewer Service Plan.
Section 4. The City of Bainbridge Island will define maximum density allowable
within the City of Bainbridge Island Comprehensive Plan and Zoning Ordinances in any
new development proposed for sewer services.
Section 5. In return for sewer service for new development the City of Balnbridge
Island will require binding covenants for public benefits, such as trails and open space.
Section 6. The City of Bainbridge Island will require that whenever development
densities are proposed for less than what is allowed under current zoning, and the
proposal is approved by the City, in return for sewer service, the development shall
exercise written covenants that will run with the land to gu_~rantee such density reduction.
Section 7. When contracting for sewer treatment with Sewer District No. 7, the
City of Bainbridge Island will follow Sewer District No. 7 policies regarding extension of
sewer service outside their boundaries.
Section 8. The sewer service to new development and sewer service to address
emergency service to existing development are separate issues which may proceed
independently.
