RES 99-16 NOT IMPOSING FOREST PRACTICE ACT MORATORIUM ON TAMMY GEROY'S PARCELResolution No. 99 - 16 A Resolution of the City Council of the City of Bainbridge Island, Washington, not imposing a six-year Forest Practice Act development moratorium on a parcel owned by Tammy Gemy on the Hidden Cove Road. WHEREAS, Tammy Gcroy is the owner of parcel number 2502-1-034-2009 located on the northwest comer of State Highway 305 and Hidden Cove Road; and WHEREAS, The property was harvested under a Class II forest practice permit (309- 23861) dated 6/4/95; and WHEREAS, The application for a class H forest practices permit states that the applicant proposes an odina~ timber harvest and reforestation project and the applicant does not intend to impwve or develop the property within three year; and WHEREAS, by letter to Mayor Dwight Sutton dated 26 April 1999, Tammy Oeroy requested that the City Council provide a written confirmation regarding the City of Balnbridge Islaml's intent to impose a Forest Practice Act development moratorium; and WHEREAS, based on the consideration that the City did not have Conversion Option Harvest process in 1995 and the harvest was a partial cut that would have met the standards of the veg_a~on management program (BIMC Chapter 16.22) the City Council does not desire to place a six-year development moratorium on any or all applications for development permits or approvals for this parcel; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, that the City shall not impose a six-year moratorium on any or all development permits or approvals for the Geroy parcels pursuant to forest practice permits issued for this parcel on June 4, 1995 (permit number N-09-23861).
