RES 99-28 SETTING A PUBLIC HEARING REGARDING A VACATION OF A PORTION OF SOUTH BEACH DRIVERESOLUTION NO. 99-28 A RESOLUTION of the City Council of the City of Bainbridge Island, Washington, setting a date and time for a Public Hearing on a petition to vacate a portion of South Beach Drive, a public Right-Of-Way pursuant to abutting property owners' petition therefor, and providing for the publication and mailing to property owners of notice of the hearing. WHEREAS, a petition was filed with the City Clerk on October 4, 1999 for vacation of a portion of South Beach Drive, a public Right-Of-Way(ROW), and WHEREAS, the Public Works Department has prepared the Certificate of Sufficiency, as required by State law (copy attached), and has determined the petition does meet Sufficiency requirements. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, as follows: Section 1. The Public Hearing on the petition to vacate a portion of South Beach Drive, as described in the originally submitted abutting property owners' petition, on file with the City of Bainbridge Island, will be held before the Public Works Committee on Monday, November 29, 1999 at 4:30 PM, local time, in the Public Works Engineering Conference Room at 911 Hildebrand Place, Bainbridge Island, Washington. Section 2. In accordance with RCW 35.79.020, the City Clerk is directed to cause notice of the Public Hearing to be given within twenty days, by written notice posted in three of the most public places in the City and a like notice in a conspicuous place on the street or alley sought to be vacated. We have identified that a conversion of the apartments to condominiums and a complete renovation is the highest use for the property. Covered, garage parking is requir, ed in order to. be able to market the condominiums for sale. Without a garage parking stall for each unit, we will not be able to sell the units at a price that will. justify the costs of construction. We have. tried various scenarios for fitting garages on to - the site. Unfortunately, between the various iide setback requirements shared with us by the planning department and the rules for the number 6f access points pointed out by Mr. Jeff Jensen in a memo to Bob Katai dated February 16, 1999, we have been severely limited in configuring the property to provide the required number of garages. .. The latest plan t;dr providing garages as detailed drawing sheet A-l, completed by Mr. Steve Myrvang dated March 18, 1999, provides a solution that appears to work withhi the various limitations on the site. The limited space between the buildings and the existing roadway, as · well as the actual physical dimensions of the property requires moving the existing roa. dway. These limitations also create 'the need for this application for partial mad vacation. The road and garage relocation requires that the fight of way be moved from its existing location North to the very edge of the property. It also requires that the right of way be reduced from its existing 60 feet to 48 feet along the majority of its length on the property. Accordingly, we are requesting a vacation of 12 feet of the right of way, per the attached survey completed by Adam & Goldsworthy, Inc dated 5/14/99. Currently, parking for the apartments is provided on the City right-of way via direct head on parking on a gravel shoulder to the north of the existing S. Beach Drive. This parking requires every vehicle to back out on to the street when exiting. This is not a safe situation and is not in compliance with current codes. As we understand it, this situation would never be allowed under existing rules but since it already exists, it can remain in its "as is" status. According to conversations with JeffJensen last spring, the road way will never be utilized any where close to the level that it is designated. The road serves as access to single family residences only to the east. All residences to the west will leave their property and proceed up to Fort Ward without using ~his section of roadway. The number of residents to the east is limited and should not expand much, if at all, due to a very limited number of building sites. This road will never need to be expanded to four lanes, meaning a 60 or even a 50 foot fight of way will never be needed. The proposed 48 foot right of way will be sufficient to meet any future needs that might occur. . 2. The City and surrounding neighbors will benefit from the new roadway and sidewalks that we' will construct. The new roadway will be built to current codes. 3. The City and surrounding neighbors will benefit from increased safety that will be recognized by eliminating the current unsafe parking condition. The. City will retain some affordable housing units that would other4vise be lost if the condominium project does not pro.ceed. The alt.ernative ihvestment scenario for the existing owners should the condominium plan not proceed. is to remove the apartment b'uilding and sell three individual waterfront lots to be used for single family homes2.
