RES 2000-26 CLEANUP OF BAINBRIDGE ISLAND LANDFILL AND ITS FUTURE USE AND ACQUISITIONRESOLUTION NO. 2000-26
A Resolution of the City of Bainbridge Island, Washington regarding
clean-up of the Bainbridge Island Landfill and future acquisition and use
of that property.
WHEREAS, the Bainbridge Island Landfill ("the Landfill") is owned by Kitsap County
and is a closed municipal landfill that once served the residents of Bainbridge Island; and
WHEREAS, Kitsap County is currently developing plans to clean up the Landfill and is
considering the option of removing the majority of the waste and reclaiming the site; and
WHEREAS, the Landfill occupies approximately seven (7) acres of a total 40 -acre parcel,
which is otherwise undeveloped except for a small transfer station and recycling center on site;
and
WHEREAS, Kitsap County officials have discussed with City of Bainbridge Island
officials the possibility of cost-sharing for the clean-up and eventual conveyance of the property
to the City; and;
WHEREAS, the County and City agree that the cost to reclaim the landfill should be
shared equally although the parties shall seek other funding avenues and apply such grants to the
total costs if and when received, and
WHEREAS, the City and County intend to enter into an interlocal agreement pursuant to
RCW Ch. 39.34 setting forth the specific obligations and authorities of the parties with respect to
the landfill clean up and conveyance of the property; and
WHEREAS, the consideration for the interlocal agreement will be the eventual
conveyance of the property to the City for a public use or other use approved by the County, the
City's assumption of monitoring the site after the conveyance, and the avoidance of litigation
costs for both the City and the County for cost recovery under RCW 70.105D.080.
NOW, THEREFORE, BE IT RESOLVED that the Bainbridge Island City Council
hereby authorizes the administration to negotiate an Interlocal Agreement with Kitsap County to
share the costs of the clean up of the Landfill and to work with the County in developing a plan
to convey the property to the City in exchange for the City's sharing in the costs.
