RES 2016-23 APPROVING THE FINAL ROOST SUBDIVISIONRESOLUTION NO. 2016-23 A RESOLUTION of the City of Bainbridge Island, Washington, approving the final Roost subdivision (File No. PLN5076SUB). WHEREAS, on May 20, 2015, the preliminary subdivision application for the Roost subdivision was submitted by Jeb and Belinda Thornburg, Roost Land Co. LLC, and Blue Moon Land Co. LLC, to the Department of Planning and Community Development; and WHEREAS, on July 17, 2015, the Pelican Industries four -lot short plat vacation (Bainbridge Island Short Plat No. BI -6, recorded at AF #9310110094) was submitted to the Department of Planning and Community Development; and WHEREAS, on May 11, 2016, a preliminary hearing was held on the Pelican Industries short plat vacation and the Roost subdivision; and WHEREAS, the hearing was continued by the Hearing Examiner for two weeks to allow briefing of issues related to the proposed vacation of the underlying Pelican Industries short plat; and WHEREAS, on May 31, 2016, the Hearing Examiner approved the preliminary Roost subdivision with conditions; and WHEREAS, in that same May 31, 2016 decision, the Hearing Examiner determined that the City Council was the appropriate legislative authority to vacate the related short plat in accordance with RCW 58.17.212; and WHEREAS, on September 27, 2016, a public hearing on the Pelican Industries short plat vacation was held before the City Council, in accordance with the procedures of RCW 58.17.212; and WHEREAS, the City Council, following the public hearing on the matter, approved Resolution 2016-22, approving the four -lot Pelican Industries short plat vacation; and WHEREAS, on September 8, 2016, the applicant submitted the final Roost subdivision application to the Department of Planning and Community Development; and WHEREAS, on February 12, 2016, the City Engineer reviewed and forwarded a recommendation of approval to the Department of Planning and Community Development; and WHEREAS, the Department of Planning and Community Development has evaluated compliance with the conditions imposed on the preliminary plat and forwarded its recommendation for final subdivision approval to the City Council; and WHEREAS, the City Council held a closed record hearing regarding approval of the final Roost subdivision on September 27, 2016. THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. All conditions imposed by the preliminary subdivision approval have been met, as set forth in the final subdivision memorandum from the Department of Planning and Community Development. Section 2. The Roost subdivision conforms to the zoning ordinance, the Comprehensive Plan, the subdivision regulations and standards, and all applicable land use ordinances and applicable state law in effect. Section 3. The City Council finds that bonds and assurance devices submitted by the applicant adequately assure completion of all required plat improvements. Section 4. The City Council hereby approves the Roost subdivision (File No. PLN5076SUB). Section 5. The City Council hereby authorizes the Mayor to inscribe the City Council's approval on the face of the final plat, as depicted in attached Exhibit C and incorporated by reference; provided that upon approval of the final plat amendment, the City Council may direct and authorize another councilmember to inscribe the City Council's approval on the face of the final plat.
