ORD 69-19 BOARD OF ADJUSTMENT APPEALSORDINANCE NO. 69-19 AN ORDINANCE OF the Town of Winslow, Washington creating a Board of Adjustment and Appeals for the Town, defining the terms of its members, the powers of the Board, and incorporating all relevant provisions of Ordinance No. 69-16 and Ordinance 66 of the Town of Winslow, adopted September 19, 1969 and June 3, 1958 respectively. WHEREAS the Town of Winslow, Washington has heretofore adopted a comprehensive zoning code by its Ordinance No. 69-16 adopted September 19, 1969 and the Uniform Building Code by Ordinance 66 adopted June 3, 1958, which contain rules, regulations, powers and other matters relating to a Board of Adjustment for the Town of Winslow, Washington, and it is now appropriate that a Board of Adjustment be created to perform the functions and carry out the duties imposed by Ordinance No. 69-16 and Ordinance 66. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF WINSLOW, WASHINGTON: Section 1. There is hereby created a Board of Adjustment and Appeals of the Town of Winslow, Washington (hereinafter called the "Board") consisting of three members, each to be appointed by the Mayor and approved by the Council, to serve without compensation for a term of six years, subject to removal by the Mayor, approved by the Council, for cause. Original appointees to the Board shall serve staggered teLms of one for two years, one for four years, and one for six years, respectively. Section 2. Said Board shall utilize the work done by the Planning Commission and the appropriate employees of the Town in connection with the performance of its duties The Board shall have all of the duties and perform all of the functions provided for it by Ordinances No. 69-16 and Ordinance 66 particularly section 204, 1961 edition of the Town of Winslow, Washington, the relevant provisions of which are hereby incorporated into this Ordinance by reference thereto. To the extent not provided for in Ordinance No. 69-16 and Ordinance 66 the Board shall adopt rules and regulations for its own government not inconsistent with the provisions of Ordinance No 69-16 or Ordinance 66, and shall keep records of its examinations and other official actions taken by it~ all of which shall be ix~ediately filed in the Office of the Clerk of the Town and shall be a public record. All actions of the Board shall be by resolution which shall include the reason for each decision. The concurring vote of two members of the Board sh~ll be necessary to decide in favor of an application of an application or any matter upon which it is required to render a decision under this Ordinance or Ordinances No. 69-16 and Ordinance No. 66. All procedures of the Board when hearing appeals under Section 204 of the Uniform Building Code shall be regulated by the provisions of Ordinance 69-16 governing the Board of Adjustment and Appeals.
