ORD 69-23 APPOINTIVE OFFICESORDInAnCE? d AN ORDINANCE of the City of Winslow, Washington, relating to appointive offices; establishing and naming those offices which shall be filled by appointment and confirmation of the City and establishing the method of appointment and con- firmation of those persons appointed. WHEREAS, the City of Winslow, Washington, is now classified as a non-charter code city under that certain act of the Legislature known as the "Optional Municipal Code";and WHEREAS, pursuant to the powers granted to non-charter code cities under the Optional Municipal Code, the appointive officers for a non-charter code city shall be those provided for by Charter or Ordinance; and WHEREAS, the City of Winslow, Washington, does not now have a charter and wishes to provide for the offices whose positions will be filled on an appointment and confirmation basis, NOW, THEREFORE, the Council of the City of Winslow, Washington do ordain as follows: Section 1. The following offices of the City of Winslow are hereby established and the same shall be filled by appoint- ment and confirmation as hereinafter set forth in this Ordinance: A. City Clerk - Treasurer (Combined as allowed in C. D. RCW 35A.12.020) Deputy City Clerk - Treasurer Chief Law Enforcement Officer Maintenance Foreman A~l~a,~ Mainlwmam,~ F ..... n City Attorney City Engineer All members of the planning commission and the Board of Adjustment. I I ~...~, ~ ~. Fire Marshall ~" ~': Police Judge Section 2. The Mayor shall appoint such persons as he deems appropriate to fill the positions above stated. Any appoint- ment by the Mayor shall be subject to approval by a majority of the Council. The term "majority" as used herein shall mean a majority of the whole membership of the Council. Section 3. The Mayor shall have the power of removal of any appointive officer, subject to any applicable law, rule or regulation relating to civil service except that a police ,judge or municipal fudge, who is appointed, may be removed only upon convic- tion of misconduct or malfeasance in office, or because of physical or mental disability rendering him incapable of performing the duties of his office. Section 4. The head of a department or office of the City Government may be authorized by the Mayor to appoint or remove subordinates in such department or office, subject to any applicable civil service provisions. Section 5. All appointments of City Officers and employees shall be made on the basis of ability and training or experience of the appointees and the duties they are to perform, from among persons having such qualifications as may be prescribed by Ordinance or by Charter, and in compliance with the provisions of any merit system applicable to the City of Winslow.
