ORD 70-04 REGULATING THE PRESENCE OF MINORS DURING CERTAIN HOURS. -~,, ORDINANCE NO . ~ v - ~' AN ORDINP.NCE of the City of G7inslour, ~^?ashington, regulating the presence of minors under the age of 18 years in public streets and other places between certain hours; defining duties of. parents or others in care of minors; providing f_or arrest and penalties for violation thereof; and repealing ordinances in conflict therewith. BE IT OP,DAIRdED by the Council of the City of ~^7inslow as follows: Section 1. It shall be unlawful for any minor under the age of. 18 years to overate a motor vehicle, to loiter, idle, ?.4~ander, stroll, play in or on the public streets, highways, roads, alleys, parks , playgrounds , wharves , docks , or other public grounds , public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places, between the hours of 10:00 o'clock P.M. and sunrise of the follo~,ring day, of_f_icial city time; provided, however, that the provisions of this section do not apply to a minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or accompanied by a member of his or her family 13 years of age or older, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person or member of the family 18 years of age or over having the care and custody of the minor. Each violation of the provisions of this Section shall con- stitute a separate offence. Section 2. It shall be unla~ti~ful f_or the parent, guardian, or other adult person having the care and custody of_ a minor under the age of 18 years to knowingly permit such minor to loiter, idle, wander, stroll, play or operate a motor vehicle in or on the pu!~lic ~. ~r streets, highways, roads, alloys, narks, playgrounds, ~~rharves, docks, or other publicgrounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsunervisec? places , ?~etween the hours of_ 10 ; 00 0' clod- ?? .r? . a_nd sunrise of the follo~•ring day, official cit~T time, nrovic~ed, however, that the pro- visions of this Section do not apply ?~rhere the minor is accompanied by hi.s or her parent, guardian, other adult person having the care and custody of the minor, or accompanied by a member of_ his or her family 18 years of_ age or older, or where the minor is upon an em.er- gency errand or legitimate business directed by his or her parent, guardian, other adult person having the care and. custody of the minor, or by a member of his family 18 ~~ears of age or older. Each violation of_ the provisions of this Section shall con- stitute a separate offence. Section 3. 11nv minor violating the nrovisi_ons of Section 1 shall be dealt with in accordance cai_th ~7uvenile Court lava and procedure. 11ny parent, guardian, or other adult person having the care and custody of a minor violating Section 2 may be fined not more than $500.00 and imprisoned not more than thirty days, or by both such fine and imprisonment. Section 4. 1111 existing ordinances of the City of_ T~~inslow are hereby revealed insofar as they may be inconsistent with the provisions of_ this Ordinance. Section 5. It is the intention of. the City Council that each separate provision of this ordinance shall >7e deemed indenenc~ent of. all other provisions herein, and it is .further the intention of_ the City Council that if any provisions of this Ordinance be declared. /'~ ~; ~. ~; ~; -2- invalid, all other provisions thereof shall remain valid and en- forceable.
