Counsel for Don and Deena Hanke, Merry McAllister, Bill Eckel and Dana Halvorsen
(Opponents) filed a timely Request for Reconsideration in this matter. The request sought
replacement of Condition 36 in the Examiner’s decision.
The City filed a response asking for removal of the condition. Counsel for Opponents
objected to the City’s response.
After considering the various submissions and reconsidering the Condition as written, the
Examiner is persuaded to follow the course recommended by the Planning Commission on this
issue, limiting the exit from the school site to “right-turn only.”
Accordingly, Condition 36 as initially written is hereby stricken, and shall be replaced by
the following language.
“36. The exit from the site shall be so constructed as to permit right-turns only
on leaving the site.”
This means that the “right turn only” restriction shall apply at all times.
