Dear Ms. Smith:
On July 11, 2017, Bricklin & Newman, LLP filed an appeal of the above - referenced
Land Use Decision on behalf of Neil Johannsen, Kiman Lucas, John Perkins, James &
Sabine Quitslund and David Ward.
On July 25, 2017, Bricklin & Newman filed a Notice of Withdrawal stating that from that
date forward I would represent the appellants.
The pre - hearing conference was postponed from August I' to allow conversations
between the appellants and John Tawresey, the owner of the property leased to Nordland
Construction for the "STO Staging Area," to reach a conclusion satisfactory to the
appellants and supported by the City.
In the intervening weeks, Mr. Tawresey, the appellants, the City Manager, the City
Attorney and the Director of the Planning Department have met several times. Mr.
Tawresey has submitted a revised Restoration Plan which addresses the principal
objections of the appellants. The time has now come to withdraw the appeal.
Enclosed please find a photocopy of the emails in which the other appellants gave me the
authority to represent them. If no further formalities are required, please confirm that the
withdrawal of the appeal has been accomplished. Our neighborhood group is already
engaged in conversations with Mr. Tawresey and City officials about details of site
"reconstruction" beyond the features specifically covered by PLN 50805 (as amended).

Yes, Dave, thanks! One good thing about the pre- hearing conference is that we can discuss when the hearing might or
will be - -we may even agree to a date. Also I expect to be given permission to talk with City officials and review all the
documents have to do with the two Tawresey "staging areas," including their contracts with Opus and Nordland. I need to
know when the City knew that the STO staging area could be moved to Cave from the highway.

I will need aerial photographs that I know you have. I will also want you, and the others, to go over the presentation - -the
narrative - -with me in advance.
It will not be NECESSARY for you to be at the actual hearing, but I would be happy if you could be.
My black -out dates are September 25- October 31. But I will certainly push for a much earlier date than November!
I think I can be ready by the second week of August. Do you have firm plans to be away from mid - August to mid -
September?
