A RESOLUTION of the City of Bainbridge Island, Washington,
amending Section 9 of the City's fee schedule to update fees in
connection with the critical areas ordinance update enacted through
Ordinance No. 2018-01 including 1) the addition of fees for a major
and minor critical area permit, a critical area site investigation, and
a buffer enhancement plan review, 2) the exemption of critical area
restoration and enhancement activities from fee requirements, 3) the
removal of fees for habitat buffer averaging, habitat management
plan review, special use review, and wetlands review, and 4) the
consolidation of all critical area permits into one subsection of the
fee schedule.
WHEREAS, the City of Bainbridge Island has charged fees for Planning, Building, and
Development activities for more than 25 years; and
WHEREAS, on February 27, 2018, the City Council enacted Ordinance No. 2018-01
which created a new permit review and approval process for critical areas; and
WHEREAS, the City's Fee Schedule needs to be updated to reflect fees for these new
permits and processes; and
WHEREAS, the City's Fee Schedule also needs to be updated to reflect changes in
descriptions and to remove fees for permits relating to critical areas that are no longer available;
and
WHEREAS, the City wishes to remove economic and administrative barriers to
applicants proposing critical area restoration and enhancement projects that are not required as
project mitigation; and
WHEREAS, RCW 82.02.020 authorizes the collection of reasonable fees to cover the
costs to the City for such activities.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DO RESOLVE AS FOLLOWS:
Section 1. Section 9, Building and Planning Fees, of the City's Fee Schedule is hereby
amended as follows:
