ORD 72-06 LICENSING OF MUSIC AND ENTERTAINMENTORDINANCE NO. 72-6 AN ORDINANCE RELATING TO MUSIC AND ENTERTAINMENT, PROVIDING FOR LICENSING THEREOF AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL of the City of Winslow, Washington as follows: SECTION 1. No person, firm or corporation shall permit upon its premises any music without a license to so do issued by the City Clerk upon application as more particularly hereinafter provided. SECTION 2. Any person desiring to apply for such license shall file written applization with the City Clerk and the City Clerk shall forthwith deliver said application to the Chief of Police who, within ten days thereof, shall, in writing, endorse thereon either his approval or disapproval. Said application shall be returned to the City Clerk who thereupon shall present the same to the City Council for final approval or disapproval. Said appli- cation shall be granted by the Council whenever it appears that such license and activity would not be inconsistant with public peace, health, safety, morals and welfare, and, for the purpose of making such administrative determination, the Council may order a public hearing of the application to be held, in which event all interested parties shall be given reasonable notice and an opportunity to appear before the Council. Upon approval of the City Council and upon proof of payment of the fee thereof to the City Treasurer, the City Clerk shall issue the license. SECTION 3. The fee for such license shall be $50.00 per year and shall be issued in the name of the person, firm, or corporation operating the establishment in which such ~usic is to be played and shall be valid only in such establishment. Said license shall not be transferred except in case of a bona fide sale of the business conducted by such licensee within such estab- lishment. SECTION 4. The term "music" for purpose of this ordin- ance shall include dancing, singing, mechanical music devices or any other sound emitting device, except radio and television. SECTION 5. Any license issued pursuant to this ordinance shall be subject, where applicable, to any rules or regulations of the Washington State Liquor Control Board relating to the sale of intoxicating liquor. SECTION 6. This ordinance shall not apply to private clubs holding licenses authorizing the sale of beer, wine and spirituous liquor for consMmption on the premises but all clubs shall, never-the-less, be subject to the rules and regulations of the Washington State Liquor Control Board relating to music, danc- ing or entertainment within such club. For the purpose of this ordinance, a club is an organization of persons, incorporated or unincorporated, operated solely for fraternal, benevolent, educa- tional, athletic or social purposes and not for pecuniary gain. SECTION 7. Any persons violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed $300.00 or by imprisonment in jail for not more than ninety days or by both such fine and imprisonment. SECTION 8. Item 3 of Sectiom 4 of Ordinance No. 3 as amended on DeCember 21, 1954 is hereby rescinded and of no further force and effect.
