ORD 73-12 WATER LINE EXTENSIONORDINANCE NO. 73- AN ORDINANCE OF THE CITY OF WINSLOW, A MUNICIPAL CORPORATION, DECLARING THE INTENTION OF THE CITY TO ORDER THE FORMATION OF A LOCAL IMPROVEMENT DISTRICT FOR THE CONSTRUCTION AND INSTALLATION OF WATER LINE EXTENSION, SETTING FORTH THE NATURE AND TERRITORIAL EXTENT OF SUCH PRO- POSED IMPROVEMENT STATING THE ESTIMATED COST AND EXPENSE OF THE IMPROVEMENT AND THE AMOUNT THEREOF PROPOSED TO BE BORNE BY THE PROPERTY WITHIN THE PROPOSED LOCAL IMPROVEMENT~DI~STRICT ~ Preamble On May 7, 1973 the City Council of the City of Winslow adopted Resolution No. 73-4 declaring the intention of the City to establish the formation of a Local Improvement District for the acquisition, construction and installation of extension to the City's water system within an area whose boundaries were set forth in said Resolution. Resolution No. 73-4 sets forth the nature and territorial extent of the proposed extension, the estimated cost and established a public hearing to be held on the 29th day of May, 1973. Notice of the adoption of Resolution No. 73-4 was duly and regularly published on May 12th and 14th in the Bremerton Sun, a newspaper of general circulation, within Kitsap County and a copy of said Notice was delivered to each property owner residing within the proposed Local Improve- ment District which notice set forth the property description and the estimated total assessment. The public hearing was held on May 29, 1973 and following the public hearing recommendations were made to the Council that the formation of the Local Improvement District should proceed. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WINSLOW DO ORDAIN AS FOLLOWS: Section 1. It is the intention of the City of Winslow to order the improvement of the following described area within the City limits of the City of Winslow by the construction and installation of an extension to the City's water system described in Section 2 below: Boundaries of proposed Local Improvement District: That portion of Government Lot 4, Section 27, Town- ship 25 North, Range 2 East, W.M., described as follows: Beginning at the Southwest corner of said Government Lot No. 4; thence Easterly along the South line of said Section 27 to a point which lies 68.06 feet N 89°32'50'' W of the Meander Corner at the inter- section of the Meander Line and the South line of said Section 27; thence Northerly 297.5 feet, more or less, thence Westerly 325 feet, more or less, to the East right-of-way line of Wood Avenue S.W., thence Northerly along the East right-of-way line of Wood Avenue S.W. projected 122.5 feet, more or less to the North right- of-way line of Parfitt Way S.W.; thence Westerly along the North right of way line of Parfitt Way S.W. to a point that lies 247.5 feet East of the West line of said Government Lot No. 4; thence Southerly to the South right-of-way line of Parfitt Way S.W.; thence continuing Southerly 276.06 feet; thence Westerly 247.5 feet to the West line of said Government Lot No. 4; thence Southerly 106 feet to the Point of Beginning. All of Government Lot No. 1, Section 34, Township 25 North, Range 2 East, W.M. except the Easterly 70 feet thereof, more particularly described as follows: Beginning at the Meander Corner which is the Northeast corner of said Government Lot 1; thence along the Meander Line S 44000'04" W 70 feet; thence N 20°51'40'~ W 54.39 feet to a point on the North line of said Section 34; thence N 89°32'50'' E 68.06 feet along the North line of said Section 34 to the Point of Beginning. Section 2. The nature and territorial extent of the improvement shall be the acquisition, construction and installation of a 6 inch loop extension to the City's water system together with all fittings, valves, and fire hydrants to serve the residents of the Local Improvement District and shall lie along, over, and under the following described streets, avenues, and private easements in the City of Winslow: ON FROM TO Wood Avenue S.W. A private easemen Parfitt Way S.W. All water lines to be installed shall be in accordance with Section 2 of Resolution 73-4 and the City shall be authorized to acquire all rights-of-way, easements and property rights necessary for the construction of the aforesaid extensions to the City ' s water system. Section 3. The proposed Local Improvement District shall be designated Local Improvement District No. 2. Section 4. The estimated cost of acquiring, constructing and installing the additions and betterments authorized in Section 2 hereof is $10,000, and it is proposed that 100% of such cost shall be borne by assessments levied against property within the Local Improvement District and specially benefitted by said improvement. Section 5. The nature of the improvements authorized in Section 2 hereof is such that the special benefits conferred on the lots, tracts, and parcels of land within the area described in Section 1 hereof are not in all cases fairly reflected in the use of the zone and termini method of computing assessments and there- fore the assessments made against said lots, tracts, and parcels of land shall be made in accordance with the special benefits such property will derive from said improvements. Section 6. The City Engineer of the City of Winslow is directed to proceed with said improvement after 30 days from the adoption of and publication of this ordinance provided that sufficient restraints by protests are not received pursuant to RCW 35.43.180. on this a , 1973. ,, //--/' "'/7~ /~'~> ~- '~,'-~i. /~' ,.x'd .........-~ ............
