RES 98-02 NOT IMPOSING FOREST ACT MORATORIUM ON PARCELS OWNED BY MEY, LITTLE, AND ARNOLDRESOLUTION NO. 98-02 A RESOLUTION of the City Council of the City of Bainbridge Island, Washington, not imposing a six-year Forest Practices Act development moratorium on one parcel owned by Kenneth Mey, one parcel owned by Christa Little and parcels owned by Alice Arnold on Sportsman Club Road. WHEREAS, Alice Arnold is the owner of two adjacent parcels abutting Sportsman Club Road and having tax parcel numbers 222502-3-066-204 and 222502-3- 068-2002 ('Arnold parcels'); Kenneth Mey is the owner of a parcel abutting one of the Arnold parcels and having tax parcel number 222502-3-067-2003 ("Mey parcel'); and Christa Little is the owner of a parcel abutting one of the Arnold parcels and having tax parcel number 222502-3-069-2001 ('Little parcel"); and WHEREAS, in 1992, Alice Arnold applied to the Department of Natural Resources for a class IV general forest practices permit for the Arnold, Mey and Little parcels, but the permit was never issued; and WHEREAS, the Department of Natural Resources issued class II forest practices permits dated June 19, 1995 for the Arnold parcels and the Mey parcel, and dated January 3, 1996 for the Little parcel; and WHEREAS, the application for a class II forest practices permit states that the applicant proposed an ordinary timber harvest and reforestation project and that the applicant does not intend to improve or develop the property within three years; and WHEREAS, the class II forest practices permit warns the permittee that the local jurisdiction (city) may for six years after the date of the application deny any or all applications for development permits or approvals, due to the fact that the parcel is being logged as a forestry operation; and WHEREAS, by letter to Dwight Sutton dated November 28, 1997, Christa Little, on behalf of all three parcel owners, states that they are interested in developing the parcels; and WHEREAS, based on the unique circumstances relating to the City's consideration of the 1992 class IV general forest practices permit application, the City's development and adoption of the vegatation management program (BIMC Chapter 16.22), and the interaction between the City and the parcel owners from 1992 through 1996, the City Council desires not to place a six-year moratorium on any or all applications for development permits or approvals for the parcels; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, that the City shall not impose a six- year moratorium on any or all development permits or approvals for the Arnold, Mey and Little parcels pursuant to the Class II forest practices permits issued for those parcels on June 19, 1995 and January 3, 1996 (permit numbers FP-N-09-23969, FP-N-09-23968, FP-N-09-24738, respectively).
