RES 98-06 SETTING FEES WHEN DEBTS ARE TURNED OVER TO COLLECTIONS RESOLUTION No. 98 - 06 A RESOLUTION OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON SETTING FEES TO BE CHARGED WHEN A DEBT OWED TO THE CITY MUST BE TURNED OVER TO A COLLECTION AGENCY FOR COLLECTION. WHEREAS, in 1997 the Washington State Legislature in passing SSB 5827 authorized cities to use the services of a collection agency to collect amounts owed and to add reasonable fees, payable by the debtor, to the amount owed; and WHEREAS, the City Council has determined in Ordinance 97-29 that the use of a collection agency is necessary to collect amounts owed to the City and that the cost of those services should be paid by the debtor; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: SECTION 1. In those cases when the City deems that it is necessary to use a collection agency in order to collect amounts owed to the City, a collection fee shall be added to the amount due in the following amounts: If the amount owed to the City is $100.00 or less, the collection fee shall be equal to the amount owed to the City before the addition of the collection fee. If the amount owed to the City is greater than $100.00, the collection fee shall be 50 % of the amount owed to the City before the addition of the collection fee. SECTION 2. This resolution shall be effective on and after March 2,1998. PASSED by the City Council this 19th day of February, 1998. APPROVED by the Mayor this 20th day of February, 1998.
