ORD 74-12 DOG LICENSING AND REPEALING ORDS 116 & 147 r !y ORDINANCE N0. 74-12 4 ~G ~A* ~~~ ~ `°' ' ~ ~ ~~ AN ORDINANCE RELATING `TO THE LICENSING OF DOGS, ~' REPEALING ORDINANCE N0. 116 AND ORDINANCE N0. I47. BE IT ORDAINED by the City Council of the City of Winslow, Washington as follows: SECTION I. Dog Licenses Required. It shall be unlaw- ful for any person, firm, corporation, organization or de- partment to own, keep or have control of any dog over the age of four (4) months within the City of L,iinslow unless said person, firm, corporation, organization or department shall have procured a license therefore as hereinafter pro- vided. SECTION 2. License Fee. The following fees shall be ~~, paid for licenses hereunder: For each dog ..............$3.00 PROVIDED, that licenses and tags shall be provided free of charge by th;~: City of ~dinslow to guide dogs properly {~-- ~ trained to assist blind persons when such dogs are actually being used by blind persons for the purpose of aiding them in going from place to place; to dogs being currently trained ~~-"" for such purpose in such school or program as has been ap- proved or accredited by a professional organization or asso- ciation, either for profit or not for profit; and to pups and young dogs being raised to be trained on reaching ma- turity as guide dogs, under the 4-H program known as "Guide Dogs for the Blind." Licens3_ng agents, in writing such 1i- censer, shall insert the words "Guide Dog" in the space al- lotted for, and in place of, a stated fee. SECTION 3. Date Due. All licenses granted hereunder •'~~~. shall be due and payable the first day of July of each year. If the license fee above-provided for 'is. not paid on or be- fore August 31 of each year, the applicant shall pay a pen- ~r~~~`-~`~~' alty fee of .x"3.00 for each license in addition to the regular ~`,r fee as stated above. PROVIDED, said applicant shall not pay ~~,•~'"? the penalty fee if he has been a resident of the City of T~inslow for thirty (30) days or less; has owned, kept or been in control of said dog for thirty (30) days or less; or said dog, at the time of the application for license is five (5) months of age or less. SECTION 4. Issuance of`Licerrse~:~ It shall be the duty of the City Cleric, his appointee or his authorized agent, to issue licenses to persons applying therefore upon pay- ment of the license fee as herein provided, and a tag for each dog licensed. The licenses shall be dated and numbered and shall bear the name of Winslow, ~w'ashington, the name, address and telephone number of the o~ner or keeper of the dog licensed, the name of the dog, and a description of the ~og, including its age, sex and color. l~e tag shall bear the name of Winslow, Washington, a serial number correspond- ing with the number on the license, and the date of expir- ation. it shall be the duty of every owner or keeper of a ~og to keep a substantial collar on the dog and attached firm!~ thereto the license tag for the current licensing year . SECTION 5. Licenses Non-Transferable. Dog licenses as provided herein shall not be transferable from one dog to anoti~er. P~OVIDED, that nothing herein contained shall be constcued to prevent a license being transferred from one o~.mer or keeper to another. Pi~OVIDED FURI'H!~R, that in the event an o~mer or keeper shall move from another political s~bdivision of Kitsap County into the City of ~{inslow during the year in which said license is current, said license shall be honored by the City of l{inslow so long as the license is current. SECTION 6. Lost 'rags. Lost license tags may be re- placed by a substitute identification tag upon payment of $!.00 to the City Clerk, appointee, or authorized agent. SECTION 7. ~Jnlawful to Remove License 'rag. it shall be m~lawful for any person other than the o~er or keeper to remove a license tag from any dog licensed under the pro- visions of this ordinance. SEC'rtO~ 8. Unlicensed Dogs impounded. All dogs not licensed hereunder, or who do not exhibit the license ident- ification tag as hereinabove provided, are declared to be a nuisance and may be seized and impounded. SECTIO~ 9. Penalty. Any person who refuses, or fails to cor~!y with, or violates any of the provisions of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not to exceed $500.00 or by i~rison- ment not to exceed ninety days, or by both such fine and imprisonment. SECTION 10. Severability. Should any part of this or- dinance be adjudged invalid for any reason, such adjudica- tion shall not affect the validity of this ordinance as a whole. SECTIO~ 11. Repealer. Ordinances Nos. 116 and 147 hereby are repealed in their entirety. SEC'flOm 12. Effective Date. This ordinance shall be- come effective five (5) days after its publication.
