RES 98-09 APPROVAL OF WEAVER LANDING SUBDIVISION PRELIM PLAT (SUB10-30-97-1).RESOLUTION NO. 98-09 A RESOLUTION of the City of Bainbridge Island, Washington, approving the Weaver Landing Subdivision preliminary plat (Case No. SUB10-30-97-1). WHEREAS, on October 30, 1997, a preliminary plat application was submitted by John and Alice Tawresey to the Department of Planning and Community Development; and WHEREAS, the preliminary plat application facilitates development of 18 residential lots on 11.6 acres of real property located west of Weaver Road NE, south of High School Road NE, and east of Sportsman Club Road NE; and WHEREAS, the Department of Planning and Community Development reviewed and forwarded its recommendation for conditional approval to the Hearing Examiner; and WHEREAS, on January 16, 1998, the Hearing Examiner conducted a public hearing on the preliminary plat upon proper notice; and WHEREAS, on February 4, 1998, the Hearing Examiner recommended conditional approval of the preliminary plat and entered a report, Findings of Fact, Conclusions of Law and Recommendations; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WAHSINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner (Case No. SUB10-30-97-1), as set forth in Exhibit "A', which is attached and incorporated by reference, is adopted as the final decision of the Bainbridge Island City Council except as follows: 1) Condition 5A, of the Hearing Examiner's Decision should read: Prior to any clearing, grading, or construction activities, fencing shall be installed at the'eastern perimeter of the wetland buffer; Condition 5C, of the Hearing Examiner's Decision should read: Prior to issuance of occupancy permits on residences constructed on lots adjoining the wetland buffer, any construction fencing along the eastern perimeter of the wetland buffer shah be replaced with split rail fencing; Condition 26, of the Hearing Examiner's Decision should read: Lots 10 and 11 will be reserved for construction of residences which meet the City's affordable housing requirements as specified in BIMC Chapter 18.90, or as hereafter amended. A note shall be placed on the final plat which requires that any attached units resemble, as closely as possible, a single family dwelling Section 2. The proposed subdivision is in conformance with the zoning ordinance, the comprehensive plan, the subdivision regulations and subdivision standards, and all other applicable !and use ordinances and applicable state law in effect at the time of preliminary plat approval. Section 3. The final plat of Weaver Landing Subdivision shall state on its face that it is subject to the conditions of approval set forth in this resolution.
