ORD 75-12 LOITERING AND PROWLINGORDINANCE NO. 75-12
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON
REPEALING SECTION 28 OF ORDINANCE 74-4 DENOMINATED
"LOITERING AND PROWLING"
WHEREAS Winslow Ordinance No. 74-4 contains Section 28
denominated "Loitering and Prowling" which ordinance provision
was based upon the Model Penal Code, Proposed Official Draft
Section 250.6 of the American Law Institute (1962); and
WHEREAS the Washington State Supreme Court in Bellevue v.
Miller, 85 Wn. 2d 539 (1975) has declared that said provisions
are unconstitutional, now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL that Section 28 deno-
minated "Loitering and Prowling" of Winslow Ordinance No. 74-4 be
and hereby is repealed and that all other sections and provisions
of Ordinance No. 74-4 shall remain in full force and effect.
