ORD 76-15 POLICE DEPARTMENTORDINANCE NO. 76- 15 AN ORDINANCE OF THE CITY OF WINSLOW RELATING TO THE POLICE DEPARTMENT OF SAID CITY, ADOPTING A SYSTEM OF CIVIL SERVICE FOR THE CHIEF OF POLICE AND ALL FULL PAID EMPLOYEES THEREOF; CREATING A CIVIL SERVICE COMMISSION; AND REPEALING ORDINANCE 70-8. The City Council of the City of Winslow do ordain as follows: Section 1. Except as provided herein, the City of Winslow hereby adopts a civil service system as set forth in RCW 41.12 (Laws of 1937, Chapter 13) for the Police Department of the City of Winslow, and all full time paid employees therein, and all advancements, demotions, suspensions, discharges or control thereof, and of the members thereof, shall be under the control of and governed by civil service rules prescribed in or adopted pursuant to RCW 41.12 as if the same may have been heretofore or may be hereafter amended. Section 2. There is hereby created for the administration of such civil service for the Police Department, a Civil Service Commission composed of three members who shall be appointed by the Mayor of the City of Winslow with the concurrence of the City Council. Term of office of such Civil Service Commission shall be six years, and the present Civil Service Commissioners shall serve in said position until expiration of their existing terms of office, resignation or removal. In the event any Civil Service Commissioner shall resign, becomes disqualified or be removed for cause, another commissioner shall be appointed to take his place for the unexpired portion of the term. Section 3. The provisions of this Ordinance shall be applicable to only full time employees employed by the City of Winslow after the effective date of this ordinance. Section 4. The Commission shall organize itself, hold meetings, adopt rules and regulations, and perform the duties and exercise the powers of the commission in accordance with the pro- visions of Washington State law. Section 5. All applicants for employment with, advancement in, or the filling of a vacancy in, the Police Department of the City of Winslow shall be required to have specified qualifications, have tenure of office, and be subject to removal, as provided in the Civil Service Regulations adopted by the Commission con- sistent with the law of the State of Washington except that in the employment, advancement and filling of vacancies in the Department, the Commission shall certify to the appointing power the names of the three persons highest on the eligible list for the Class (or the list held appropriate for such class) to which the vacant position has been allocated, or willing to accept employment, the appointing power shall select one of the three persons to be appointed to the available position. Section 6. The appointing power for the position of the Chief of Police shall be the Mayor of the City of Winslow with the concurrence of the City Council. All other positions shall be appointed by the Chief of Police but only with the concurrence of the Mayor of the City of Winslow. Section 7. Any rules and regulations adopted by the exist- ing Civil Service Commission pursuant to Ordinance 70-8 are deemed in full force and effect until amended or repealed by the Civil Service Commission. Section 8. In the event any of the provisions of this ordinance shall be declared invalid, the other provisions shall not be affected thereby, and shall remain in full force and effect.
