CITY OF WINSLOW ORDINANCE NO. 76-17
AN ORDINANCE OF THE CITIES OF POULSBO AND WINSLOW
ESTABLISHING PROCEDURES FOR ENFORCEMENT OF
REGULATIONS AND RULES PROMULGATED BY THE WASHINGTON
STATE HEALTH DEPARTMENT AND THE KITSAP COUNTY HEALTH
DISTRICT, PROVIDING FOR NOTICES OF VIOLATIONS THERE-
OF, AND ESTABLISHING CIVIL AND CRIMINAL PENALTIES
FOR VIOLATIONS OF SAID RULES AND REGULATIONS.
WHEREAS, pursuant to RCW 70.05, et seq., the Kitsap County
Health District is authorized to promulgate and enforce health
rules and regulations within the cities of Poulsbo and Winslow;
and
WHEREAS, specific enforcement procedures have not been pre-
viously established and that such procedures are necessary for the
public health, safety and welfare.
NOW, THEREFORE, the City Councils of the Cities of Poulsbo
and Winslow do ordain as follows:
1. All rules and regulations adopted or promulgated by the
Washington State Health Department or the Kitsap County Health
District and which affect property or residents of the Cities of
Poulsbo or Winslow shall be fully applicable within the respective
city limits.
2. Authority for enforcement of said rules and regulations
shall be vested in the duly authorized representatives of the
Kitsap County Health District.
3. In the event a violation of any rule or regulation
referred to in this ordinance occurs within either the City of
Poulsbo or Winslow, the appropriate enforcement official shall
prepare and serve a written notice setting forth said violation
with a copy of the rule or regulation alleged to have been violated
which notice shall be served upon the owner or occupant of the
premises wherein the violation occurred or is occurring and if
the violation is continuing, the notice shall give a reasonable
time to correct said violation· The notice so prepared and
served shall state that unless the violation is corrected within
the time provided therein, the enforcement official may request
the municipal court of the city to issue a Summons supported by
a complaint alleging said violation and that upon conviction
thereof said violator could be fined not more than Five Hundred
Dollars ($500.00) or imprisoned for six (6) months in the city
jail, or both such fine and imprisonment·
4. In addition to the criminal penalties provided above?
the enforcement official is authorized to request the City Attorney
to commence civil proceedings to enjoin said violation in Superior
Court of Kitsap County.
5. All ordinances of either the Cities of Poulsbo and
Winslow which are in conflict with this ordinance shall be deemed
repealed. If any provision of this ordinance is found invalid or
unconstitutional, all other provisions shall remain in full force
and effect.
