AN ORDINANCE OF THE CITY OF WINSLOW RELATING TO
THE ESTABLISHMENT OF A PLANNING AGENCY, PROVIDING
FOR MEMBERSHIP THEREIN, PRESCRIBING DUTIES AND
RESPONSIBILITIES OF SAID AGENCY AND REPEALING
ORDINANCE NO. 32.
The City Council of the City of Winslow do ordain as follows:
SECTION 1.
Pursuant to the provisions of RCW 35A.63 there is hereby
established within the City of Winslow, a Planning Agency which
shall have the following duties and responsibilities:
1. Preparation of a continuous review of the Comprehensive
Plan for the City of Winslow.
2. Review, investigate and make formal recommendations on
all applications for amendments to the Comprehensive
Plan, official zoning map and official zoning ordinance
of the City, applications for variances, conditional
use permits and planned unit developments and all
applications for permits issued pursuant to the Shore-
lines Management Act.
3. Such other advisory duties as may be assigned to it by
the City Council or the Mayor.
SECTION 2. MEMBERSHIP.
The Planning Agency shall consist of seven (7) members ap-
pointed by the Mayor and confirmed by the City Council who shall
serve without compensation for four (4) year terms. At least
five (5) members of the Planning Agency shall be residents of the
City and two (2) members may be nonresidents but any nonresident
appointed to the Planning Agency shall be either (i) the owner of
real property located within the city limits or (ii) the owner of
not less than 50% of a business licensed to do business within the
city limits.
SECTION 3. ~ETINGS
The Planning Agency shall meet on the first and third Thursday
of each month at 7:30 p.m. in the Winslow City Hall and may hold
such other special meetings as the Planning Agency may determine
and all meetings of the Planning Agency shall be open to the public.
In the event the regular scheduled meeting falls upon a legal
holiday, the meeting shall be held on the next following business
day. Annually, at the first meeting in January or at such other
times as may be necessary, the Planning Agency shall elect from its
members one person to serve as chairman and the chairman shall
preside at all meetings which shall be conducted according to
Roberts Rules of Order. The chairman shall be entitled to vote
on all matters coming before the Agency.
SECTION 4. SPECIAL MEETINGS.
Any special meeting of the Planning Agency shall only be held
after notice thereof has been published at least 24 hours in
advance and notification of the special meeting together with the
nature and matters to come before the meeting have been provided
to the news media.
SECTION 5. INTERIM PROCEDURES.
The existing Planning Commission shall be deemed the Planning
Agency and the members thereof shall continue to serve for their
full terms.
SECTION 6o PUBLIC RECORDS.
All meetings of the Planning Agency shall be electronically
recorded and the tapes preserved for three (3) years from the
date of such meeting, but shall not be transcribed unless
ordered by the Chairman. In the event any litigation results
which involves any matter upon which the Planning Agency has made
a recommendation, the electronic tapes shall be preserved until
final termination of such litigation. In the event the recordings
of meetings are required for use in court· it shall be the
responsibility of the appellant to pay the cost of transcribing
said recordings and nothing contained herein shall prevent an
appellant from having an official stenographer record any pro-
ceedings of the Planning Agency.
All recommendations, reports and other official matters of
the Planning Agency shall be signed by the Chairman, attested by
the Secretary who shall be required to maintain minutes of each
meeting. The minutes do not need to reflect the actual discussion,
but only the formal actions taken by the Planning Agency.
SECTION 7. FINANCIAL AND BUDGET REQUEST.
On or before the fourth Monday of September of each year·
the Planning Agency Chairman shall submit to the Mayor a budget
for the forthcoming fiscal year which may include all expenses for
conducting meetings of the Planning Agency including secretarial
services or travel expenses for members of the Planning Agency.
SECTION 8. CONSULTANTS.
Upon approval of the City Council the Planning Agency may
recommend the retention of a Planning Consultant who assists the
Planning Agency in its deliberations who shall be hired by the
City. The Planning Agency, through its Chairman, may request
formal opinions or recommendations from the City Attorney or City
Engineer on any matter that is pending before it.
SECTION 9. REPEALER.
Ordinance 32 of the City of Winslow is hereby repealed.
SECTION 10. EFFECTIVE DATE.
This ordinance shall become effective on the 1st day of
jarlu~tr'~ 19 77 and shall be published in the manner
provided by law.
