ORD 77-05 SELLING LIQUOR TO INTOXICATED PERSONSWINSLOW ORDINANCE NO. 7 7 - 5 kN ORDINANCE AD~NDING THE POULSBO-WINSLOW CRIMINAL CODE TO PROHIBIT THE SELLING OF LIQUOR TO INTOXICATED PERSONS. THE CITY COUNCILS OF THE CITY OF POULSBO AND THE CITY OF WINSL0 DO ORDAIN AS FOLLOWS: Section 1. A new Section 94.110 is added to the Poulsbo-Winslow Criminal Code, reading as follows: 94.110. Selling Liquor to Intoxicated Person. (1) A person is guilty of selling liquor to an intoxicated person if he directly or through an employee transfers for payment or other consideration any liquor as defined in Section 94.090 of this ordinance to any intoxicated person. Under this section, an employer is equally responsible with an employee who makes such a sale. (2) For purposes of this section, a person is "intoxicated" when as a result of drinking liquor there is an impairment of his mental or physical faculties so as to diminish his ability to think and act with ordinary care. (3) It is an affirmative defense that the person selling the liquor reasonably believed that the purchaser was not intoxicated.
